A.
Pursuant to and in accordance with the provisions
of N.J.S.A. 40:55-1 et seq.,[1] there shall be a Planning Board of and for the Township,
which shall consist of nine members classified as follows:
(1)
Class I: the Chairman of the Township Committee, ex
officio.
(2)
Class II: one of the officials of the Township to
be appointed by the Chairman of the Township Committee.
(3)
Class III: a member of the Township Committee other
than the Chairman, to be appointed by the Township Committee.
(4)
Class IV: six other citizens of the Township, to be
appointed by the Chairman of the Township Committee thereof.

There shall be two alternate members for Class IV.
The alternate members shall be appointed by the Township Committee,
and their terms shall expire at the end of each year. They shall be
designated by the Chairman as "Alternate No. 1" and "Alternate No.
2" and shall be entitled to sit with and participate as a member in
any hearing before the Board. They shall have all of the powers granted
to them in accordance with N.J.S.A. 40:55-1.4, as amended.[2]

All members of the Board shall serve without
compensation. The terms of the members composing Classes I and III
shall correspond to their respective official tenure; the term of
the member composing Class II shall terminate with the term of the
Chairman of the Township Committee who appointed him; the term of
one member of Class IV first appointed shall expire at the end of
each year, beginning at the end of the first year, but thereafter
the term of each member of Class IV shall be the same number of years
as there are members of the class on the Board. Any vacancy in any
class occurring otherwise than by expiration of term shall be filled
by appointment in the manner herein provided for the unexpired term.
Any member of the Board may, but only after a public hearing, be removed
from the Board by the officer or body appointing him for inefficiency,
neglect of duty or malfeasance in office.
The Planning Board, when appointed, shall organize
by electing a Chairman from the members of the Planning Board falling
within Classification IV and may create and fill such other offices
as the Planning Board may determine. The Planning Board shall have
the power and authority to employ experts and a staff and to pay for
their services and other necessary expenses not exceeding, exclusive
of gifts, the amount which may be appropriated for the use of the
Planning Board for any given year by the Township Committee.
After the organization of the Planning Board,
the Chairman of the Township Committee may, in his discretion, appoint
a Citizens Advisory Committee to represent the civic and other organizations
of the Township and to collaborate with the Planning Board in its
studies, and the Advisory Committee shall elect its own officers and
determine its own procedure.
The Planning Board shall have the powers and
duties provided by Chapter 433 of the Laws of 1953, and the amendments
and supplements thereto.[1] In accordance with Section 14 of Chapter 433 of the Laws
of 1953,[2] the Planning Board is authorized to review subdivisions
and to recommend final approval to the Township Committee in keeping
with the provisions of the Land Subdivision Ordinance of the Township
of Maplewood.[3] There is hereby excepted from the requirement of Township
approval any subdivision of a lot, tract or parcel of land along,
over or through which no undedicated street or no dedicated but unimproved
street passes or which does not require the extension of the Township
sanitary or storm sewer system, provided that such subdivision complies
in all respects with the provisions of the Zoning Ordinance of the
Township.
Violation of any regulation duly adopted by
the Planning Board shall make the violator subject to any penalty
provided by this Code.
