A. 
The International Property Maintenance Code (IPMC), as from time to time amended and supplemented, be and is hereby adopted as the Property Maintenance Code for the Township of Maplewood for the control of buildings and structures as herein provided, and each and all of the regulations, provisions, penalties, conditions and terms of the IPMC are hereby referred to, adopted and made a part hereof as if fully set forth herein, with the additions, insertions, deletions and changes, if any, prescribed below.
B. 
Copies of the IPMC shall be maintained in the Office of the Township Clerk and the Office of the Township Building Department and may be purchased through the Office of the Township Clerk.
The IPMC is amended and revised as follows:
A. 
In Section 101.1, replace "[NAME OF JURISDICTION]" with: "Township of Maplewood."
B. 
In Section 102.3, replace all italics, International and ICC codes names with: "New Jersey Uniform Construction Code, N.J.A.C. 5:23;" replace "ICC Zoning Code" with: "Maplewood Zoning and Development Ordinance and its amendments."[1]

C. 
Section 103.5 is deleted and replaced with:
105.3 Fees. Fees are set forth in Maplewood Code, Chapter 123.
D. 
Section 106.4 is deleted and replaced with:

106.4 Violation penalties.
106.4.1
Any person found to be in violation of the provisions of this chapter shall be subject to a fine as follows:
1.
First offense: $250.
2.
Second offense: $500.
3.
Any subsequent offense: an amount not to exceed $2,000.
106.4.2
Each day a violation continues shall be deemed a separate offense.

Section 109-5 is amended to read as follows:

109-5 Costs of emergency repairs. Costs incurred in the performance of emergency work shall be paid by the Township of Maplewood (“Township”). The Township Attorney for the Township shall institute appropriate action against the owner of the property where the unsafe structure is or is located for the recovery of such costs.
In addition to any other remedies available for a violation of this section, the Township may abate any imminent danger, nuisance, correct a defect or put a property in proper condition pursuant to the provisions of N.J.S.A. 40:48-2.12f. Where abatement of any imminent danger, as defined, correction of a defect in the property or maintenance in a proper condition so as to comply with the requirements of any municipal ordinance or state law requires expending Township monies, the Code Official shall present a report of the work proposed to be done to accomplish the abatement to the Township Committee, together with an estimate of the cost for abatement, along with a summary of the proceedings undertaken by the Code Official to secure compliance, including notices served upon the owners, operators, lessors or agents. The Township may, by resolution, authorize the abatement necessary to place the property in proper condition and in compliance with the ordinances of the Township and the laws of the State of New Jersey. The Code Official may thereafter proceed to have the work performed in accordance with the resolution at the Township’s expense, not to exceed the amount specified in the resolution, and shall, upon completion of the work, submit a report of the monies expended to the Township Committee. After review, the Township Committee may approve the expenses and costs, and the expenses and costs shall become a lien against the property and shall be added to and form a portion of the taxes to be assessed and levied upon the property, the same to bear interest at the same rate as taxes, and shall be collected and enforced in the same manner as are taxes. A copy of the resolution approving the expenses and costs shall be certified by the Township Clerk and filed with the Tax Collector.
Notwithstanding the foregoing, any instance where the Code Official determines the need for property maintenance of a property to conform to the Municipal Code, the cost of which does not exceed $200 in any one instance, the Code Official may direct the property maintenance be completed, and the cost of same shall become a lien against the property and shall be added to and form a portion of the taxes to be assessed and levied upon the property, the same to bear interest at the same rate as taxes, and shall be collected and enforced in the same manner as are taxes.
E. 
Section 111 is deleted.
F. 
Section 201.3 is deleted and replaced with:
201.3 Terms defined in other codes. All terms shall have the meaning ascribed within the State of New Jersey Construction Code, N.J.A.C. 5:23 (NJUCC). Any terms otherwise not defined in the NJUCC shall have the meaning ascribed in the IPMC, the International Building Code, International Fire Code, International Zoning Code, International Planning Code, International Mechanical Code or the ICC Electrical Code.
G. 
In Section 202, General Definitions, the following shall be added:
BEDROOM. Any bedroom located on the lower floor or level of a dwelling must have an egress-sized window and a height from the floor of the bedroom to the window sill of not more than 42 inches. The surrounding grade at the exterior shall be such that the use of the egress windows permits its use without restrictions or obstructions.
INOPERABLE MOTOR VEHICLE. Including but not limited to being unlicensed, inspection out of date, wrecked and/or abandoned.
G.1. 
Section 301.3, Vacant structures and land, shall be amended to read as follows:

301.3 Structures and land. All structures and premises thereon or vacant land located within the Township of Maplewood shall be maintained in a clean, safe, secure and sanitary condition as provided herein, so as not to cause a blighting problem or adversely affect the public health or safety.
H. 
In Section 302.4, Weeds, replace "(jurisdiction to insert height in inches)" with: "10 inches in height."
I. 
Section 302.8 is deleted and replaced with:
302.8 Motor vehicles. Except as provided for in other regulations, no currently unregistered or uninspected motor vehicles shall be parked, kept or stored on any premises, and no vehicle shall, at any time, be in a state of major disassembly, disrepair or in the process of being stripped or dismantled. Exceptions: No more than one vehicle of any type is permitted to undergo a major overhaul, including body work, provided that such work is performed inside a structure or similarly enclosed area designed and approved for such purposes.
J. 
In Section 307.2.1, the following shall be added:
Rubbish and garbage shall be placed or kept on the property within the building located thereon or not nearer to the street line than the face of the building, whichever distance from the street line is greater, except during any day designated for pickup during any cleanup week proclaimed by the Township Committee or recycling pickup in accordance with § 235-16 of the Code of the Township of Maplewood.
K. 
In Section 307.2.2, the following shall be added:
Containers. The owner and/or operator of every commercial property shall provide, at all times cause to be utilized, leakproof-approved containers provided with close-fitting covers for the storage of garbage and/or rubbish until removed from the premises for disposal. All such containers shall be screened to be obscured from view from adjacent property, parking areas, streets and residences.
L. 
In Section 307.3.2, the following shall be added:

M. 
In Section 404.5, the following shall be added:
Supplement. A room located below the level of the ground but with the floor level less than 3 1/2 feet below the average grade of the ground adjacent to and within 15 feet of the exterior walls of the room may be used for sleeping purposes, provided that the walls and floor thereof in contact with the earth have been damp-proofed in accordance with a method approved by the administrative authority.
N. 
In Section 505.1, delete "International Plumbing Code" and replace with: "National Standard Plumbing Code, N.J.A.C. 5:23."
O. 
In Section 602.2, delete "ICC Plumbing Code" and replace with: "National Standard Plumbing Code, N.J.A.C. 5:23."
P. 
In Section 602.3, delete "[date]" in two locations and insert "October 1" and "April 30," respectively.
