As used in this chapter, the following terms shall have the meanings indicated:
FOOD
Any raw, cooked or processed edible substances, water, ice, beverage, milk, milk product or ingredient used or intended for use or for sale in whole or in part for human consumption.
FOOD ESTABLISHMENT
Includes any place, building, vehicle or device in which food is manufactured, sold, stored, prepared, served or handled with intent to sell or distribute.
FOOD PROCESSING
The preparation, handling, cooking, reconstituting and packaging of food. "Food processing" shall not include the preparation and sale of coffee or tea at a retail food establishment.
PACKAGED
Bottled, canned, cartoned or securely wrapped.

Maplewood Township does adopt and incorporate herein all the provisions of N.J.A.C. 8:24.
A. 
Issuance. No person shall conduct, maintain or operate a food establishment in the Township who does not possess a license from the Board of Health. Such license shall not be transferable and shall continue in force and effect until January 1 next ensuing the date of granting thereof.
B. 
Fee for food establishments involved in food processing. A fee of $150 per year shall be charged for licenses for food establishments involved in food processing.

C. 
Fee for food establishments that sell only packaged food. A fee of $100 per year shall be charged for licenses for food establishments that are not involved in food processing, but which receive, store and distribute or sell only food that is packaged.

D. 
One-day licenses. A fee of $25 shall be charged for food establishments that are licensed to sell for one day only.
E. 
Exemptions from licensing fee. No fee shall be charged for food establishments operated by or in conjunction with public school, church or incorporated charitable institutions.
F. 
A reinspection fee of $50 shall be charged for each and every reinspection visit required based on a "conditional" or "unsatisfactory" inspection.

G. 
Application. An application as prepared by the Board of Health shall be submitted with the required fee.
H. 
Violations of the provisions of this chapter shall subject the violator to fines as follows:

(1) 
First offense: $200.
(2) 
Second offense: $400.
(3) 
Third offense and any subsequent offense: $500; each day that a violation continues shall be deemed a separate event.
