As used in this chapter, the following terms
shall have the meanings indicated:
Includes all recyclable aluminum, cans.
Branches, woody plants, and other like vegetative material
not exceeding five inches in diameter, and Christmas trees. Brush
does not, include leaves and grass clippings,
Nonfood containers constructed of two pieces of paper with
a corrugated center, i.e., appliance boxes, etc. The term does not
include cardboard items made of chipboard, such as shirt boxes, shoe
boxes, milk cartons, cereal boxes and all other similarly constructed
items.
Televisions, CPUs, monitors, laptops and mercury-containing
devices.
Lamps that contain mercury.
Includes all products made from silica or sand, soda ash
and limestone, the product being transparent or translucent and being
used for packaging or bottling of various matter and all other materials
commonly known as "glass," excluding, however, blue and flat glass
commonly known as "window glass."
Asphalt, block, brick, cinder and concrete.
Glossy inserts, magazines, telephone books, junk mail, colored
paper, computer paper, office paper, paperboard (chipboard and pressboard),
nonmetallic wrapping paper, soft-cover books, hard-cover books with
covers removed and fine paper.
Includes all individuals, partnerships, corporations, owners,
tenants, lessees, occupants, associations and organizations residing
or owning, operating, managing, leasing or occupying any premises
or business, commercial or industrial within the Township of Plainsboro.
Soda bottles made of PETE (SPI code No. 1) and milk, water
and laundry product bottles made of HDPE (SPI code No. 2); excluding
products containing or that contained household hazardous waste.
Stretch/shrink wrap, plastic shopping bags for warehouses,
retail establishments and supermarkets with 25 or more employees.
Nickel cadmium (Ni-Cd), Nickel metal hydride (Ni-MH), lithium
ion (LI-ion) and small sealed lead (Pb).
Includes all garbage and rubbish normally collected for the
residents and commercial occupants of the Township of Plainsboro.
Tin plated, bi-metal and other ferrous food and beverage
containers.
Clean, dry clothing or other fabric measuring at least one
foot by one foot in size.
Rubber-based scrap automotive, truck and equipment tires.
Includes paper of the type commonly referred to as "newsprint"
and distributed at stated intervals, usually daily or weekly, having
printed thereon news and opinions and containing advertisements and
other matters of public interest.
Washers, dryers, ranges, refrigerators, dehumidifiers and
air conditioners. Note: all devices that contain CFCs must be properly
removed by licensed individuals and all CFCs recovered must be sent
to an EPA approved reclaimer.
Unfinished lumber from new construction projects, including
pallets. Unfinished shall mean nonchemically treated wood. This term
shall not include pressure-treated wood which has been impregnated
with preservatives, insecticides, fungicides, creosote, or other chemicals;
wood that has been painted, resin-coated or otherwise surface treated;
wood that is laminated or bonded; or other wood which has been similarly
altered from its natural conditions.

A.
On or after the date fixed and promulgated by the
regulations issued by the Municipal Recycling Coordinator and in accordance
with the terms hereof, it shall be mandatory for all residents and
nonresidents who are owners, lessees or occupants of commercial businesses
and offices, industrial and institutional facilities, government and
office parks located within the Township of Plainsboro to separate
used newspaper, mixed paper, clean corrugated cardboard, glass and
plastic containers, aluminum and steel cans, masonry/paving materials,
rechargeable batteries, tires, white goods, electronics, fluorescent
bulbs, plastic film, textiles, wood scrap, brush, leaves and motor
oil from all other solid waste produced and deliver such items to
the designated dropoff point within the Township of Plainsboro or
comply with whatever other regulations for recycling promulgated by
the Municipal Recycling Coordinator.
B.
On or after the date fixed and promulgated by the
regulations issued by the Municipal Recycling Coordinator and in accordance
with the terms hereof, it shall be mandatory for all residents and
nonresidents who are owners, lessees or occupants of residential structures,
including multifamily residences, located within the Township to separate
used newspaper, mixed paper, clean corrugated cardboard, glass and
plastic containers, aluminum and steel cans, masonry/paving materials,
rechargeable batteries, tires, white goods, textiles, brush, leaves
and motor oil from all other solid waste produced and deliver such
items to the designated dropoff point within the Township or comply
with whatever other regulations promulgated by the Municipal Recycling
Coordinator.
The owner, lessee and occupant of any residential,
commercial business, commercial office or institutional use located
within the Township of Plainsboro, who shall place for disposal, removal
or collection the following items, shall conform to the following
regulations:
A.
Used newspaper, used paper and clean corrugated cardboard
shall be bundled separately and secured in bundles not exceeding 50
pounds and shall not be contained in plastic bags.
B.
Glass and aluminum cans shall be contained in suitable
containers supplied by owners, lessees or occupants.
C.
Before glass and aluminum containers are delivered
to the designated dropoff points, they shall be thoroughly rinsed.

From the time of dropoff at any designated center
or curbside of used newspaper, used paper, clean corrugated cardboard,
glass and aluminum cans for collection by the Township of Plainsboro,
in accordance with the terms hereof, such used newspaper, used paper,
clean corrugated cardboard, glass and aluminum cans shall be and become
the property of the Township of Plainsboro or its authorized agent.
It shall be a violation of this chapter for any person unauthorized
by the Township of Plainsboro to collect, remove or cause to be collected
or removed any such recyclables. Each such collection in violation
hereof from any one or more sources shall constitute a separate and
distinct offense punishable as hereinafter provided.
The Municipal Recycling Coordinator is hereby
authorized and directed to establish and promulgate reasonable regulations
as to the manner, days and time for the collection of used newspaper,
used paper, clean corrugated cardboard, glass and aluminum cans in
accordance with the terms hereof. Such regulations shall be promulgated
and become effective not later than four months from the date hereof.
The governing body may change, modify, repeal or amend any portion
of said rules and regulations.
Any person, firm or entity who violates or neglects to comply with any provision of this chapter or any regulations promulgated pursuant thereto, shall, upon conviction thereof, be punished by a fine not exceeding $500, except that the maximum fine for failure to comply with §§ 77-2 and 77-3 hereof, and rules and regulations issued pursuant thereto, shall not exceed $25. No enforcement of this chapter shall be made until six months after the effective date of regulations authorized to be promulgated hereunder.
It shall be the duty of the Municipal Recycling
Coordinator to enforce all of the provisions of this chapter. Upon
his becoming aware of any violation of any provision of this chapter,
the Municipal Recycling Coordinator or his authorized designee shall
institute such action as may be necessary to terminate the violation,
including issuing a summons to appear in the Plainsboro Township Municipal
Court or any other appropriate tribunal.

A.
Leaves shall be added to the Plainsboro Recycling
Ordinance as an item requiring separation and recycling by all residents
and nonresidents who are owners, lessees or occupants in Plainsboro
Township.
B.
The owners or managers of all commercial businesses,
commercial offices and institutional uses located within the Township
of Plainsboro shall have the following additional recycling requirements:
(1)
A recycling system must be established for all mandated
materials.
(2)
Recycling containers must be clearly marked and adequate
to hold materials between collections.
(3)
The owner/manager is responsible for arranging for
recyclables to be removed from the premises and assuring that they
are marketed.
(4)
The owner/manager must provide notice to employees
and customers if they are impacted by the recycling system.
(5)
The owner/manager must arrange for reports of recycling
tonnage information to be submitted to Plainsboro Township on a quarterly
basis.
C.
The owners or managers of all multifamily uses within
the Township of Plainsboro shall have the following additional recycling
requirements:
(1)
Drop-off or curbside collection must be provided for
all mandated materials.
(2)
Drop-off containers must be clearly marked and adequate
to hold materials between collections.
(3)
The management is responsible for arranging for recyclables
to be removed from the premises and assuring that they are marketed.
(4)
Management must issue notifications to tenants every
three months.
(5)
Management must arrange for reports of recycling tonnage
information to be submitted to Plainsboro Township on a quarterly
basis.

The Municipal Recycling Coordinator shall cooperate
with the Middlesex County Improvement Authority to develop and implement
a comprehensive public education program to elicit the full cooperation
of the Township's citizens in the recycling effort.
