A.
There is hereby established in the Township of Rochelle
Park a State Uniform Construction Code enforcing agency to be known
as the "Code Enforcement Department." This Department shall consist
of the following:
(1)
Director of the Code Enforcement Department/Construction
Code Official/Property Maintenance Officer.
(2)
Building Subcode Official/Zoning Enforcement Officer.
(3)
Plumbing Subcode Official.
(4)
Electrical Subcode Official.
(5)
Fire Protection Subcode Official.
(6)
Control person.
(7)
Such other subcode officials for such additional subcodes
as the Commissioner of the Department of Community Affairs, State
of New Jersey, shall hereafter adopt as part of the State Uniform
Construction Code.
B.
Each official position created in Subsection A hereof shall be filled by a person qualified for such position pursuant to N.J.S.A. 52:27D-119 et seq., and N.J.A.C. 5:23, provided that in lieu of any particular subcode official, an on-site inspection agency may be retained by contract pursuant to N.J.A.C. 5:23. More than one such official position may be held by the same person, provided that such person is qualified pursuant to the aforementioned laws.
C.
The public shall have the right to do business with
the Code Enforcement Department at one office location, except for
emergencies and unforseen or unavoidable circumstances, during such
hours as may be determined and established by the Township Committee.
These hours shall include at least one evening per week.
D.
All personnel shall be appointed or assigned to the
Code Enforcement Department by the Township Committee pursuant to
law.
E.
The Director of the Code Enforcement Department/Construction
Code Official/Property Maintenance Officer shall be a full-time employee
of the Township of Rochelle Park who shall have the following duties
and responsibilities. The following list is intended to be illustrative,
not exhaustive, and, therefore, this individual employee shall perform
all other work and services as required by this position as welt as
by state law:
(1)
Represent the Department, on behalf of the Township
Committee, to the public.
(2)
Identify goals and establish annual business plan
to serve as a constant improvement.
(3)
Manage all staff assigned to the Building, Zoning
and Property Maintenance Departments.
(a)
Maintain job description and work force.
(6)
Coordinate local permit review, inspection and maintenance.
(7)
Supervise, administrate and assist support staff,
including control person. This shall include preparation of annual
evaluations of all staff members.
(8)
Organize business systems, put in place monitoring
controls, organize filing and provide procedures to ensure maintenance
of approvals.
(9)
Review permit and inspection processes to offer final
approvals and/or actions.
(a)
Review and call for prior approvals.
(b)
Call for subcode review.
(c)
Review all applications to the Zoning Board of Adjustment
and submit a written report and evaluation to the Zoning Board of
Adjustment on each application reviewed.

Attend all meetings of the Rochelle Park Planning
Board.

Respond to and assist in connection with any and all
emergencies which may from time to time arise and which involve any
areas under the jurisdiction of the Building, Zoning and Property
Maintenance Departments.
F.
The positions of Building Subcode Official, Plumbing
Subcode Official, Electrical Subcode Official and Fire Protection
Subcode Official shall be part-time positions and the position of
control person shall be a full-time position. The Township Committee
shall attempt, when possible, to appoint one person to hold more than
one subcode official, provided that same is permissible pursuant to
state law.
G.
The salaries and other terms, conditions, obligations and entitlements of employment shall be determined pursuant to the Annual Salary Ordinance adopted by the Township Committee of the Township of Rochelle Park, and the employee holding such position shall fully comply with and be bound by Chapter 27 of the Code of the Township of Rochelle Park entitled "Personnel."
H.
All employees of the Department shall, at all times,
maintain a maximum level of professionalism and courtesy in all dealings
with members of the public and in a timely manner. The employee shall
recognize, at all times, that they are public servants who have been
appointed to their position to serve the Township of Rochelle Park,
its residents, taxpayers, property owners and developers.
J.
Additional duties.
(1)
In addition to the enforcement of the State Uniform
Construction Code and other state codes described above, the Code
Enforcement Department shall be charged with the responsibility of
supervision and enforcement of the following:

The Construction Official shall be the chief administrator
of the Code Enforcement Department.
The Township of Rochelle Park shall be subject
to the jurisdiction of the Bergen County Construction Board of Appeals
as the administrative agency responsible for handling appeals pursuant
to the Uniform Construction Code of the State of New Jersey.

A.
The fee for a construction permit shall be the sum of the subcode
fees, plus all applicable special fees, listed herein and shall be
issued as required by the Uniform Construction Code Regulations, N.J.A.C.
5:23-2.15(e)3i(3). A separate fee computed by volume or estimated
cost will be charged at the same rate as designated.
B.
Building subcode fees shall be:

State training surcharge fee: $0.0022 per cubic foot.
(a)
State training fee based upon estimated cost: $0.00009 per cost.
(4)
Combinations of renovations and additions are to be determined by
combining the fees for the appropriate parts.
(5)
Partial permits for footings and foundation: no additional fee.
(6)
Semipermanent trailers used for construction offices and storage:
$315 commercial.
(8)
Certificate of approval: $0.
(11)
Annual permits as per N.J.A.C. 5:23-2.14: one to 25, $667/worker.
(13)
Swimming pools, including fences (aboveground): $125 each.
(14)
Swimming pools, including fences (in-ground): $500 each.
(15)
Swimming pools (public): $525 each.
(16)
Relocation of structures: $500 each.
(17)
Modular houses: $500 each.
(19)
Masonry fireplaces: $150 each.
(20)
Storage tanks, including replacement: $75 each.
(20.1)
Variations: $150.
(22)
Minimum fee (includes L.P.G., flammable liquids, combustible liquids
and gases): $105 each.
C.
Mechanical and fire subcode fees shall be:

All heating appliances and HVAC equipment, including solid-fuel-burning
appliances and duct work, new or replacement: $105 each.
(3)
Fire dampers: $11 per damper.
(5)
Incinerators and crematories: $5,250 each.
(6)
Swimming pool heaters: $105 each.
(7)
Fire pumps: $1,050 each.
(8)
Central fire control center: $2,100 each.

Fire suppression systems, including water sprinkler; dry chemical;
foam; carbon dioxide; or other chemical agents:

Tank removal: $125 each.
(15)
Solar system: $125.
(16)
Private fire hydrants: $100 each.
(17)
Fire line: $250.
(18)
Minimum fire subcode fee: $125.
D.
A.
Public buildings (county and Township). No fee shall
be charged for any type of construction permitted for any building
or structure owned by the County of Bergen or the Township of Rochelle
Park or any of their subordinate agencies.
B.
The Construction Official shall, with the advice of
the subcode officials, prepare and submit to the Township Committee,
biannually, a report recommending a fee schedule based on the operating
expenses of the agency and any other expenses of the municipality
fairly attributable to the enforcement of the Stale Uniform Construction
Act.
C.
Surcharge fees.
(1)
The fee provided herein for surcharge shall be $0.0016
per cubic foot. The surcharge training fee for alterations shall be
$0.0008 per $1,000 of estimated cost.
(2)
The enforcing agency shall report annually at the
end of each fiscal year to the Bureau of Housing Inspection, and not
later than July 31, the total amount of the surcharge fee collected
in the fiscal year. In the fiscal year in which the regulations first
become effective, said report shall be for the third and fourth quarters
only.
D.
No person shall be charged a construction permit surcharge
fee or enforcing agency fee for any construction, reconstruction,
alteration or improvement designed and undertaken solely to promote
accessibility by disabled persons to an existing public or private
structure or any of the facilities contained therein.
All appointments, qualifications for appointment,
internal procedures, hearings and notice relative thereto, appeals
and filing therefor shall be and are hereby governed by Chapter 217,
Laws of New Jersey 1975,[1] and Title 5 Chapter 23, of the New Jersey Administrative
Code, as amended and supplemented, three copies of each being on file
in the Code Enforcement Department and Office of the Township Clerk.
