It shall be unlawful for any person or persons owning or having the care, custody or control of any dog to permit such dog to soil or defile or to commit any nuisance upon any sidewalk of any public street or thoroughfare or in or upon any public building or any approach to such building from the street or in or upon any public park, public playground or school playground, or in or upon the property of persons other than the owner, person or persons owning or having the care, custody or control of such dog; provided, however, that for the purpose of this section of this article, the above-mentioned restrictions shall not apply to that portion of the street lying between the curblines which shall be used to curb said dog.

No person owning, keeping or harboring any dog shall suffer or permit it to be upon the public streets or in any of the public places of the Township of Rochelle Park unless such dog is accompanied by a person who is capable of controlling the dog and who has the dog securely confined and controlled by a leash.
No person shall keep, harbor or maintain any dog which habitually barks or cries between the hours of 5:00 p.m. and 7:00 a.m.
No person shall leave a dog unattended which habitually barks or cries, and no person shall keep, harbor or maintain a dog which habitually barks or cries while unattended.

Any person who violates or refuses to comply with the regulations of this article shall be liable for a first offense to a penalty of not less than $5 nor more than $25. For a second offense, the fine shall be not less than $25 nor more than $100. For a third offense, a court appearance shall be required before the Judge of the Municipal Court of the Township of Rochelle Park, and a fine shall be imposed not to exceed $200.

A mandatory court appearance shall also be required and a fine shall be imposed not to exceed $200 by the Municipal Judge for a dog running at large who attacks someone.

A. 
The Township of Rochelle Park hereby adopts by reference P.L. 1994, c. 187, N.J.S.A. 4:19-17 through 4:19-37. Should a dog be considered vicious or potentially dangerous, the Municipal Court shall determine if, in fact, the dog is vicious or potentially dangerous.
B. 
N.J.S.A. 4:19-36 is enacted relating to any specific breed of dog and its viciousness and potential danger.
