No collection of garbage, ashes, refuse, leaves or other waste matter shall be performed or take place and no vehicles used in the collection of said material shall be operated on the streets of the Township of Rochelle Park between the hours of 7:00 p.m. and 6:00 a.m.
A. 
All garbage and ashes shall be drained free of water and stored in watertight covered cans or like containers made of either galvanized steel or such other materials which will not rust easily, equipped with proper facilities for handling and which can be readily cleaned.
B. 
Except for containers designed for pickup and disposal by private scavengers, no can or container shall exceed more than 50 pounds when full.
C. 
Except for containers or bundles designed for pickup and disposal by private scavengers, no bundle or container of rubbish, trash, hedge and tree trimmings and similar materials shall weigh more than 50 pounds. Such rubbish, trash and other debris shall be stored in a container, free from handling hazards of such quality as to prevent collapsing and littering of the streets and sidewalks or shall be securely tied in bundles not exceeding four feet in length.
D. 
No person shall litter, sweep, shake, throw, cast or lay or direct, suffer or permit any duly authorized agent under his or her control to litter, sweep, shake, throw, cast or lay or direct any ashes, garbage, paper, rust, rubbish or other refuse onto any public or private street, sidewalk, lot, place, airshaft, driveway, yard, court, catch basin or drain.
E. 
No household, commercial or industrial rubbish or garbage shall be placed in litter baskets provided by the township for the use of passing pedestrians.
F. 
The municipal collection of garbage, ashes and other refuse shall be made at the curb between the sidewalk area and the curb in front of each residential building.
G. 
With respect to premises receiving municipal collection, no property owner or occupant shall place more than four containers or bundles or more than two pieces of furniture at the curb for any one collection. Amounts in excess of the aforesaid limitation shall require the services of a private hauling or disposal company for removal.

H. 
Containers or bundles shall not be placed at the curb for collection prior to 6:00 p.m. on the day preceding collection nor shall any containers or bundles be left at the curb beyond 8:00 p.m. of the day of collection.
I. 
Collection of ashes, garbage and other refuse by private scavengers shall be made at the rear of the premises whenever possible and, if not possible, shall be made at the curb in front of the premises only in accordance with the provisions hereof.
J. 
Ashes, garbage and other refuse shall not be placed in the street or roadway, nor shall any ashes, garbage or refuse or collection container be placed upon the sidewalk so as to obstruct or interfere with pedestrian passage while such waste is awaiting collection.
K. 
Municipal collection of bulk items, such as household furniture, appliances, mattresses and similar items, shall be limited to items not in excess of 300 pounds.
L. 
No ashes, garbage or other refuse shall be transported through any public street or highway within the Township of Rochelle Park except in vehicles so covered, constructed and maintained so as to prevent leakage, attraction of flies and the scattering of contents or dust, and the body of the truck shall be constructed and covered so as to prevent such leakage or loss of materials during transit.
M. 
No person shall place or deposit within the Township of Rochelle Park any ashes, garbage or other refuse generated from outside the Township of Rochelle Park.
A. 
The removal and disposal of debris and other building materials resulting from construction of new buildings, major alterations of existing buildings or debris resulting from fire, windstorm or flood shall be the responsibility of the homeowner, contractor or individual performing the work.
B. 
The removal and disposal of any hazardous waste, as that term is defined in N.J.S.A. 13:1K-15 or any successor statute, if amended, shall be the responsibility of the generator of such hazardous waste.

Any violation of this article shall, upon conviction, be punishable as follows:
A. 
For the first offense in any calendar year, by a fine of $25.
B. 
For the second offense in any calendar year, by a fine of $50.
C. 
For the third offense in any calendar year, by a fine of between $100 and $250. A court appearance shall be mandatory for a third offense.
D. 
For the fourth offense, by a fine up to $1,000, and/or imprisonment for a term not exceeding 90 days, or any combination thereof. A court appearance shall be mandatory for a fourth offense.
E. 
If the owner of any property who is charged with violating this article chooses to enter a plea of guilty for a first or second offense, he shall be entitled to pay the fine without the necessity of a court appearance.
F. 
Separate violation. Except as otherwise provided, every day that the violation shall continue shall be deemed a separate violation.
G. 
This section may be enforced by the Department of Public Works, Health Department, Police Department, Building Department or Property Maintenance Department.
