The purpose of this article shall be to establish a procedure by which private parties may dedicate roads or streets built by them to the Town, pursuant to the provisions of the Town Law and Highway Law of the State of New York.
A. 
Inspection by Superintendent of Highways. The Superintendent of Highways must inspect the road or street to be dedicated and certify that such road has been constructed in accordance with the road specifications of the Town of Bethel as the same are set forth in Chapter A350, Street Specifications, or in conformity with such other road specifications which have been approved by the Town Board. The Superintendent of Highways must recommend to the Town Board that the Town Board accept the dedication. The inspection of the road or street should be at the discretion of the Superintendent of Highways as to time and manner of such inspection.

B. 
Title documentation. After the Town Board receives the certification from the Highway Superintendent, as provided in Subsection A hereof, the proponent of the road or street dedication shall furnish to the Town Board, subject to review and approval by the Municipal Attorney, the following items:
(1) 
A title insurance policy in the amount of $10,000 insuring title to the Town of Bethel and further certifying that the roads or streets and lands upon which they are built are free and clear of all liens, debts and encumbrances.
(2) 
A survey of the roads to be dedicated, together with a metes and bounds description thereof.
(3) 
A proposed deed of conveyance in bargain and sale with covenant form.
In the event that the facts of a particular request for dedication may require the same, the Town Board may impose such reasonable conditions to acceptance of the roads as it deems advisable, including the posting of security.
