The Police Department of the Incorporated Village of Floral Park is hereby authorized to remove or cause to be removed any vehicle parked on a public highway, in a municipal parking field or on other property owned, leased or under the control of the village where a report has been made that three or more delinquent parking tickets have been issued to such vehicle or to an individual, corporation or governmental entity in whose name such a vehicle is registered for violation of any village parking ordinance or violation of any rule, regulation or designation of the Board of Trustees with regard to parking.

Any such vehicle so removed shall be impounded and stored in a place designated by the Commissioner of Police and shall be held until it is redeemed or disposed of pursuant to § 1224 of the Vehicle and Traffic Law of the State of New York.

All sums due for delinquent parking tickets and all fees for towing, impounding and storage shall be a lien on any vehicle so impounded.

Any vehicle not claimed by its registered owner, or someone authorized in writing to act on his behalf, within 10 days of the impounding of such vehicle shall be deemed to be an abandoned vehicle and disposed of pursuant to § 1224 of the Vehicle and Traffic Law of the State of New York.

A. 
The village may convert to its own use those abandoned vehicles not affected by § 1224, Subdivision 2 of the Vehicle and Traffic Law of the State of New York, or may, by sale or gift, transfer title to any of such vehicles to any other municipal corporation for use by its law enforcement agency; provided, however, that the total number of vehicles converted and/or transferred in any calendar year may not exceed 1% of the village's unclaimed abandoned vehicles not affected by § 1224, Subdivision 2 of the Vehicle and Traffic Law of the State of New York or two such vehicles, whichever is greater.
B. 
Any proceeds from the sale of an abandoned vehicle, less expenses incurred by the village, shall be held by the village, without interest, for the benefit of the owner of such vehicle for a period of one year. If not claimed within such one-year period, such proceeds shall be paid into the general fund of the village.
