There is hereby established the position of Administrator for and under this chapter. Such position shall be known as the "Dump Administrator" and shall be unsalaried. This position shall be filled by appointment of the Town Board of the Town of Wilson, and any individual appointed to serve in this position shall serve at the pleasure of the Town Board.
A. 
The Dump Administrator shall:
(1) 
Open the dump site for dumping by persons at 10:00 a.m. each Wednesday and Thursday and close said site at 2:00 p.m. and shall open the dump site for dumping by persons at 10:00 a.m. and close said site at 12:00 noon on the second Saturday of each month, except when any of said days fall on legal public holidays as may be designated by the Town Board of Wilson.
(2) 
Open the dump site for dumping by contractors at 9:00 a.m. and close said site at 2:00 p.m. on each Tuesday, Wednesday and Thursday, except when any of said days fall on legal public holidays as may be designated by the Town Board of the Town of Wilson.
(3) 
Ensure that all refuse is dumped in an orderly fashion so as to allow for maximum efficiency in landfill operations as conducted by the custodian.
(4) 
Make a determination of the total amount of square yards or parts thereof required to properly dispose of items dumped by any person or contractor and charge said persons and contractors in accordance with the rates described in § 84-5 or any other rates set by the Town Board of the Town of Wilson after adoption of this chapter.
(5) 
Keep an accurate set of books and records relating to loads of refuse dumped, whether by residents of the Towns of Wilson, Cambria or Newfane or by private sanitary contractors. Such records shall reflect where such refuse originated and when dumped by private sanitary contractors and shall also reflect the number of loads so dumped on any given day by each said contractor.
(6) 
Direct all persons or contractors entering on the dump premises for the purpose of dumping to the proper dumping site and see that such persons leave the premises and dump site as soon as convenient immediately following the completion of the individual dumping operation.
(7) 
Report any incident involving refusal of any person or contractor to obey the rules and regulations as set forth in this chapter. Such report may be made immediately following the incident to the custodian, Supervisor of the Town of Wilson or to an authorized Magistrate for the purpose of issuing a warrant or summons under the provisions of this chapter.
(8) 
Perform such other duties within the meaning of this chapter as shall be directed by the Town Board of the Town of Wilson or the custodian.
B. 
As compensation for the services and duties to be performed by the Administrator, he shall have exclusive salvage rights within the Town dump. Such salvage rights shall immediately be discontinued upon the resignation or removal of any individual appointed as Administrator. The Administrator may exercise salvage rights only in an individual capacity and may not have any other person help, aid or assist him in any manner or in any salvage operation performed by him, except that such Administrator may employ one person to act as his assistant or in his place and stead, whether to conduct dumping operations or said individual salvage operations. Such assistant shall be subject to the approval and confirmation of the Town Board of the Town of Wilson. Salvage operations by the Administrator shall not interfere in any manner with the duties of such Administrator as prescribed under this chapter.
The Town Board of the Town of Wilson shall appoint a custodian for the Town dump. Such custodian shall, with the use of machinery provided for said Town dump, perform the landfill operation in accordance with the statutes, rules and regulations applicable therefor. Such operation shall consist of covering the refuse dumped at the Town dump site in accordance with this chapter, and the custodian shall perform such other duties as may be directed by the Town Board of the Town of Wilson.
