A.
Any person or contractor who commits or permits any act
or acts in violation of the provisions of this chapter shall be deemed to
have committed an offense against said chapter and also shall be liable for
any such violation and the penalty therefor. Any single act shall constitute
a separate violation.
B.
For every violation of this chapter, the person or contractor
violating the same or an officer, agent or employee of such person or contractor,
if a corporation, shall be subject to a fine of not more than $100 or be imprisoned
not exceeding 30 days, or by both such fine and imprisonment.
C.
Conviction for any above-mentioned violations shall constitute
and effect immediate forfeiture of any privilege to dump at the Town dump
site for a period of one year.
D.
Any person or contractor violating this chapter shall
be also subject to a civil penalty enforceable and collectible by the Town
in the amount of $100 for each separate offense or violation. Such penalty
shall be collectible by and in the name of the Town for each day that such
violation shall continue.
E.
In addition to the above-provided penalties and punishment,
the Town Board of the Town of Wilson may also maintain an action proceeding
in the name of the Town in a court of competent jurisdiction to compel compliance
with or to restrain by injunction the violation of such chapter.
Any offense or violation under this chapter is hereby declared to be
triable in any Town court of competent jurisdiction, whether the same is a
Town court situate in and for the Towns of Wilson or Cambria or Newfane.
