The following land area in the Borough of Brookville, Jefferson County, Pennsylvania, is hereby designated as the Walter Dick Memorial Park:
A. 
Bounded on the north by the breast of the dam;
B. 
Bounded on the east by the high-water mark of North Fork Creek;
C. 
Bounded on the south by the gate now located on the roadway;
D. 
Bounded on the west by a fence.

The following rules and regulations are hereby established for the management and protection of the Walter Dick Memorial Park, hereinafter designated "the Park." The hours of operation and rules and regulations of the Park may be adopted, and thereafter amended, by resolution of the Borough Council.
A. 
The Park shall be opened daily to the public between the hours of sunrise and 9:00 p.m. At 9:00 p.m., all activities in the Park shall cease and all persons in the Park shall leave as soon as possible thereafter. No person, other than authorized employees thereof, shall be in the Park at any time between 9:00 p.m. and sunrise on the following morning.
B. 
No person shall injure, deface, remove, cut or damage any of the trees, plants, shrubs, turf, buildings, structures or fixtures thereon, concrete aprons or any other property of the Borough located within the Park.
C. 
No person shall remove any bench, seat or table from the Park or change the location thereof without permission from the Borough.
D. 
No person shall conduct himself within the Park so as to annoy any other person using the Park for recreational purposes.
E. 
No person shall dispose of any waste, human excretion or garbage in the Park except in receptacles designated for the respective purposes. All persons using the Park shall dispose of all waste and garbage left by them in such proper receptacles.
F. 
No person shall injure, deface or destroy any notice, rule and/or regulation posted at any place within the Park by authority of the Borough. Nor shall any person post, at any place within the Park, any notice or placard other than by the authority of the Borough.
G. 
No person shall maintain any fire or fires in the Park except in charcoal stoves or in stoves and fireplaces maintained for the purpose and located by authority of the Borough. Fires are only permitted in the manner above set forth in the picnic area.
H. 
No person shall bring any spirituous liquor, beer, wine or any alcoholic beverage into the Park, either for his own use or for the use of any person.
I. 
No person shall engage in hunting within the Park.

J. 
No vehicles shall be parked within the Park area except in locations designated as parking areas.
K. 
All bicycles, motorbikes, motorcycles and other vehicles shall be operated on the roadway, or in the parking area only. No bicycle, motorbike, motorcycle, automobile or other vehicles of any type shall be permitted on the grass area or upon the concrete aprons within the Park.
L. 
No person shall fish in the swimming area on North Fork Creek (the area between the breast of the dam and downstream to a wire cable stretched across the creek) while a lifeguard is on duty.

No vehicles shall be parked on either side of the Water Plant roadway between United States Route Number 322 on the south and the southern boundary line of the Park on the north except in designated parking areas.
Any person who shall violate any of the rules and regulations contained in §§ 148-2 and 148-3 of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not more than $600, plus costs of prosecution, and, in default of payment of such fine and costs, to imprisonment for a term not to exceed 30 days, for each and every offense; provided each day's violation of any of the provisions of such sections shall constitute a separate offense.
