The Board of Supervisors of this township hereby signifies its intention to organize an Authority under the provisions of the Municipality Authorities Act of 1945 (the "Act").[1]

The name of the proposed Authority is "Tobyhanna Township Municipal Sewer Authority." In pursuance of said intention, the Articles of Incorporation of said Authority are hereby approved and adopted in the following form.[1]

The first members of the Board of said Authority, named in the aforesaid Articles of Incorporation, are hereby specifically appointed members of said Board for the terms set after their respective names, commencing on the date of appointment and computed from the first Monday in January 1991.
The Chairman of the Board of Supervisors of this township is hereby authorized and directed to execute said Articles of Incorporation on its behalf, and the Secretary is hereby authorized and directed to affix thereto and attest the seal of the township. Said officers are further authorized and directed to cause a notice of intention to file said Articles of Incorporation to be published as required by law, and to file said Articles of Incorporation, together with a certified copy of this article and required proofs of publication, with the Secretary of the Commonwealth of Pennsylvania, and to take all such action as they may deem necessary or appropriate to organize said Authority.
The purpose and projects of said Authority are as follows: to acquire, hold, construct, improve, maintain, operate, own and lease, either in the capacity of lessor or lessee, sewers, sewer systems or parts thereof, sewage treatment works, including works for treating and disposing of industrial waste for the Township of Tobyhanna and for such other territory as it may be authorized by law to serve, and all activities, properties and assets useful in relation thereto.

The Tobyhanna Township Board of Supervisors hereby declares its intent and desires to organize and form a municipality Authority in accordance with the provisions of the Municipality Authorities Act, 53 Pa.C.S.A. § 5601 et seq., formerly the Act of May 2, 1945, P.L. 382, No. 164, as amended and supplemented, for the purpose of making business improvements and/or providing administrative services in Tobyhanna Township as authorized under the Municipality Authorities Act and under the Neighborhood Improvement District Act, P.L. 949, Act of December 20, 2000, 73 P.S. § 831 et seq.
The name of the Authority shall be the "Tobyhanna Township Neighborhood Improvement District Authority."
The proposed Articles of Incorporation for the Authority are attached hereto as Annex "A" and specifically incorporated herein.[1]

The Articles of Incorporation of the Authority, in substantially the form attached hereto,[1] shall be executed on behalf of Tobyhanna Township by the Chairman or Vice Chair of the Tobyhanna Township Board of Supervisors and the Tobyhanna Township Secretary, and said officers are hereby authorized to file the Articles of Incorporation with the Secretary of the Commonwealth of Pennsylvania and to do all things necessary and appropriate to incorporate the Authority.

The Chairman or Vice Chair of the Board of Supervisors and the Secretary, respectively, of Tobyhanna Township are authorized and directed to cause notice of the substance of this article, including the substance of the foregoing Articles of Incorporation, and of the proposed filing of such Articles of Incorporation to be published in accordance with the Municipality Authorities Act.
The following named persons shall be and are appointed as the first members on the Board of the Tobyhanna Township Neighborhood Improvement District Authority for the following terms of office:

B. 
John J. Holahan III, 105 Government Center Way, Pocono Pines, PA 18350: two-year term that expires on December 31, 2015.

Heidi A. Pickard, 105 Government Center Way, Pocono Pines, PA 18350: three-year term that expires on December 31, 2016.
D. 
Donald J. Moyer, 105 Government Center Way, Pocono Pines, PA 18350: four-year term that expires on December 31, 2017.
E. 
Anne M. Lamberton, 105 Government Center Way, Pocono Pines, PA 18350: four-year term that expires on December 31, 2017.
F. 
John E. Kerrick, 105 Government Center Way, Pocono Pines, PA 18350: five-year term that expires on December 31, 2018.
G. 
Michelle Bisbing, 300 Community Drive, Suite D, Pocono Mountains Corporate Center East, Tobyhanna, PA 18466: five-year term that expires on December 31, 2018.
The enactment of this article is deemed necessary for the benefit and preservation of the public health, safety and welfare of, and will increase the prosperity of, the citizens of Tobyhanna Township.
