This chapter shall be known as the "Tobyhanna Township Fire Lane Parking Ordinance."
All definitions found within the Commonwealth of Pennsylvania's Vehicle Code (75 Pa.C.S.A. § 102) shall apply, as applicable to this chapter.
A. 
The Tobyhanna Township Supervisors may designate, by ordinance amendment, a fire lane on any township road or street, a private parking lot or a privately owned road, street or cartway.
B. 
Said fire lane(s) will be established by said amendment, which shall describe the exact location and the length of each fire lane(s).
A. 
A fire lane shall not be less than six feet of unobstructed width, able to withstand live loads of fire apparatus and have a minimum of 13 feet six inches (4.1 meters) of vertical clearance.
B. 
The paint utilized for the purpose of delineating the fire lane and the marking thereof as such shall be of the same chemical composition and material as used by the Pennsylvania Department of Transportation (PennDOT) for road-marking purposes. The paint shall be yellow in color and conform, in all respects, to PennDOT specifications. It is the business owner's responsibility to paint and maintain fire lanes.
Vehicles and equipment are not permitted to stop, stand or park in designated fire lanes. No obstructions shall be permitted in or around designated fire lanes. The penalty for violation of this section shall be $50, as amended by the Supervisors from time to time, and/or removal or towing at the expense of the property owner and/or the owner of the vehicle or equipment.
Violations of this chapter shall constitute a summary criminal offense, punishable by fines as above-indicated.
All signage required by this chapter shall state that no standing, stopping or parking is permitted in the fire lane. It is the business owner's responsibility to provide and maintain signage. Said signage shall be of a size and contain lettering so as to be immediately visible to all pedestrians and motorists within the fire lane. Prior to the erection of such signage, such signage shall be approved by the Tobyhanna Township Supervisors or the Zoning Officer, as the designee of the Supervisors. All signage required under this chapter shall be double-faced.
A. 
All designated fire lane signs or markings shall be maintained by the property owner in a clean and legible condition at all times, and replaced, repaired or repainted when necessary to ensure adequate visibility.
B. 
Fire lanes shall be maintained free of snow, ice, debris or any other obstruction or hazardous condition. Violators will be notified by certified mail to correct within 30 days. The penalty for violation of this section shall be $50 one day thereafter, as amended by resolution of the Tobyhanna Township Supervisors from time to time, and/or removal of the obstruction at the expense of the property owner, per violation.
