[HISTORY: Adopted by the Town Meeting of the Town of Southborough as Art. X, Secs. 6 and 7, of the 1983 Code. Amendments noted where applicable.]
A. 
The owners of land whereon is located an abandoned well or a well in use shall provide a covering for such well capable of sustaining a weight of 300 pounds or shall fill the same to the level of the ground.
B. 
The penalty for violation of this section shall be a fine of not less than $100 nor more than $500.

The Select Board may require owners of land which has been excavated to erect barriers to take other suitable measures within two days after such owner has been notified in writing by the Select Board of the Town that, in their opinion, such excavation involves and constitutes a hazard to public safety.

B. 
The penalty for violation of this section shall be a fine not to exceed $100 per day for every day such person is in violation of such notice, commencing with the fourth day thereof.
