A. 
No seasonal retail consumption license, plenary retail distribution license or limited retail distribution license shall be issued in the Borough of Hopatcong.

B. 
No license, except renewals of presently existing licenses and person-to-person transfers, shall be issued for or transferred to premises within 2,000 feet of any other alcoholic beverage licensed premises, school, church or place of worship. The distance shall be measured in the normal way that a pedestrian would properly walk from the nearest entrance of the existing licensed premises to the nearest entrance of the premises sought to be licensed. For good cause shown at a public hearing, the Borough governing body, on a case-by-case basis, may by majority vote agree to reduce the two-thousand-foot minimum required distance contained herein.

A. 
Except as provided in Subsection B herein, no licensee shall sell, serve, deliver or allow, permit or suffer the sale, service or delivery of any alcoholic beverage upon the licensed premises between the hours of 2:00 a.m. and 7:00 a.m. During the hours when sales are hereinabove prohibited, the entire licensed premises shall also be closed except for maintenance, renovations or remodeling.
B. 
On January 1 of each year, no licensee shall sell, serve, deliver or allow, permit or suffer the sale, service, delivery or consumption of any alcoholic beverage upon the licensed premises between the hours of 3:00 a.m. and 7:00 a.m. On such date the licensed premises may remain open for consumption of food and for the providing of entertainment until 5:00 a.m. During the hours of 5:00 a.m. until 7:00 a.m. the entire licensed premises shall be closed except for maintenance, renovation or remodeling.

No licensee shall allow, permit or suffer the use of any amplifying equipment upon the licensed premises outside of any building after the hour of 10:00 p.m.

A.

B. 
On January 1 of each year, no licensee shall allow, permit or suffer upon the licensed premises the playing of any music or any dancing between the hours of 4:30 a.m. and 7:00 a.m.

Any person violating any provision of Article II of this chapter shall, upon conviction, be punishable by a fine not exceeding $1,000 or imprisonment for a term not exceeding 90 days or a period of community service not exceeding 90 days, or any combination thereof.
All alcoholic beverage ordinances and resolutions heretofore adopted in the Borough of Hopatcong are hereby repealed.
