The Roland and May Eves-Mountain Inlet Wildlife
Sanctuary (hereinafter the "sanctuary") is hereby established. The
sanctuary shall be under the jurisdiction of the Borough governing
body. The purpose of the sanctuary is to establish a passive natural
area to promote the ideals of wildlife preservation, conservation,
preservation of plant life, preservation of open space and promotion
of water quality and to facilitate environmental education. Active
recreational facilities such as fields, swimming areas, boat launching
ramp facilities, playgrounds, camping or areas for organized picnics
or similar facilities are hereby deemed to be inconsistent with the
purpose of the sanctuary and are not contemplated within the sanctuary
area.
A.
All parcels of real estate currently owned by the
Borough of Hopatcong or hereinafter acquired by the Borough of Hopatcong
by any means, including but not limited to purchase, condemnation,
donation or in rem foreclosure, within the following block identification
numbers on the current Tax Maps of the Borough of Hopatcong shall
be included within the sanctuary area:

C.
Additional properties contiguous to the above-listed
block identification numbers may be added to the sanctuary area by
resolution of the Mayor and Council of the Borough of Hopatcong.
D.
The Mayor and Council of the Borough of Hopatcong
are hereby authorized to accept by resolution donations of privately
owned land within the sanctuary area. In its discretion, the Mayor
and Council may accept a donation of a less than fee simple interest
in any property, including but not limited to conservation easements,
licenses, easements and other similar interests.
A.
Conduct in general. The conduct within the sanctuary shall be subject to the provisions of Article III of this chapter.
B.
Parking. A portion of Block 70108, Lot 4, is hereby
designated as the sole vehicle parking area for the sanctuary. No
parking shall be permitted in this area between the hours of 9:30
p.m. and 6:00 a.m. of the following day. At no time shall the number
of available spaces be more than 10 spaces. The parking of boat trailers
is not permitted within the designated parking area of the sanctuary.
C.
Littering. Conduct within the boundaries of the sanctuary shall be fully subject to the provisions of Chapter 147 of the Code of the Borough of Hopatcong, entitled "Littering."
D.
Boat use and boat launching. Only the launching of
hand-carried nonmotorized boats is permitted within the confines of
the sanctuary. Motorized boats are not permitted anywhere within the
sanctuary west of Lakeside Avenue (Sussex County Route 609). Boat
launching by use of a trailer is not permitted within the sanctuary
area. The parking of boat trailers is not permitted within the sanctuary
area.
A.
This article is not intended to affect the rights
of any parties holding title or other interest to any property within
the designated sanctuary boundaries. Any development or other use
of any such parcels shall be subject to the land development ordinances
of the Borough of Hopatcong.
B.
This article is not intended to grant to the Borough
of Hopatcong or to the general public any rights whatsoever to use
or traverse any privately owned property or parcel of land within
the designated sanctuary boundary area.
