Any person, corporation, or their agents, violating any of the provisions
of this chapter shall be liable to a penalty of not less than $2 nor more
than $50 and costs of conviction, upon conviction thereof, in the Municipal
Court of the Borough of Hopatcong, and for the second and each subsequent
offense to a penalty of not less than $5 nor more than $100 and costs of conviction,
upon conviction thereof in the Municipal Court of the Borough of Hopatcong.
Any person or persons hindering or obstructing a member of the Board
of Health, or anyone duly authorized by them, in the performance of his duties,
in entering any premises for inspection, in carrying out any of the provisions
of this chapter shall be subject to a penalty of not more than $25 and costs
of conviction upon conviction thereof, in the Municipal Court of the Borough
of Hopatcong.
Any person, corporation or their agents who shall be subject to a penalty and costs under §§ 274-76 and 274-77 of this chapter and who shall refuse to pay the penalty and costs, shall be, at the discretion of the Municipal Court of the Borough of Hopatcong, confined to the Sussex County Jail for a period not exceeding 90 days, and in case a defendant shall have been twice convicted within the space of six months of the violation of the same health ordinance and due proof of such fact is made, the Borough Magistrate may, in addition to the imposition of the penalties hereinbefore prescribed, cause the defendant to be imprisoned in the county jail, with or without hard labor, for any number of days, not exceeding one for each dollar of the penalty.
