[HISTORY: Adopted by the City Council of the City of Rahway 7-9-1984 by Ord. No. A-12-84 as Ch. 120 of the 1984 Code. Amendments noted where applicable.]
The use of earphones and headphones by bicyclists and operators of motorized or self-propelled vehicles is prohibited while said persons are using municipal streets and county roads in the City of Rahway, Union County, New Jersey.
Pedestrians and joggers using earphones and headphones are required to remove said devices prior to leaving the sidewalk to cross the street or walking temporarily on the aforementioned roadways.
If any of the provisions of this chapter, or the application of such provisions, shall not be approved by the New Jersey Department of Transportation, such nonapproval shall not affect other provisions of this chapter that do not need New Jersey Department of Transportation approval.

Any person who shall violate a provision of this chapter shall, upon conviction thereof, be punished by a fine not exceeding $500 or by imprisonment for a term not exceeding 90 days, or both. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
This chapter shall not apply to police or fire officers wearing headsets while on duty, heavy machinery operators wearing headphones designed to shield them from noise and persons having a sensitivity to noise wearing ear protectors for medical reasons.
