As used in this chapter, the following terms
shall have the meanings indicated:
The burning or use of a lighted cigar, cigarette, pipe, e-cigarette,
vape or any other matter or substance which contains tobacco and/or
emits a vapor or smoke.
A.
No person attending an athletic and/or recreational event that takes place on Township property shall smoke in any area closer than 50 feet from the boundary of any athletic field and/or within 50 feet of any of the event participants whether or not such participants are engaged in event activities. No smoking shall take place in any restrooms serving an athletic and/or recreational event on Township property during the course of an athletic or recreational event. Smoking is prohibited within 50 feet of any area where food or beverages are served. This prohibition shall apply only to those athletic or recreational events where any of the participants are 18 years of age or younger. Violations of this prohibition shall be punishable as prescribed by law as stated in § 184-3 included herein.
B.
For the purposes of this section, the courtyard at the municipal
complex located between the municipal building and the library including
the Veterans' Amphitheater and walkways to the parking lots shall
be considered prohibited smoking areas as there is a reasonable anticipated
presence of children involved in the various recreational programs
as well as the library.
C.
It is further recommended that each organization that routinely utilizes
Township recreational space shall educate its participants and families
about this section and establish designated smoking areas.
Violations of this chapter shall be punishable by a minimum
fine of $100 and up to $250 for a first offense. Subsequent violations
will carry fines up to $500.
