[HISTORY: Adopted by the Board of Trustees

A.
It shall be unlawful for any person to do any of the
following acts in any public park in the Village of East Aurora:
(1)
Hours: To be present in any such public park prior
to 6:00 a.m. or later than 9:00 p.m. from September 16 through May
14 and 10:00 p.m. from May 15 through September 15 unless there for
a regularly scheduled activity of the Town of Aurora Recreation Department,
except that persons may play tennis on the tennis courts in Hamlin
Park and on South Street until 12:00 midnight on Fridays and Saturdays,
and further provided that no person shall be in the playground area
of Hamlin Park during the hours of darkness. For purposes of this
section, the words "hours of darkness" shall be that period of time
from one-half hour after sunset until one-half hour before sunrise.

Firearms: To take or otherwise possess or transport
any firearms, airguns, slingshots or bows and arrows in any such public
park, except that bows and arrows may be used in connection with responsibly
supervised archery events with written permission of the Town of Aurora
Director of Parks and Recreation.
(3)
Preservation of property: To injure, deface, disturb
or befoul any part of such public park or any of the buildings, signs,
equipment, or other property found therein, or to remove, injure or
destroy any tree, flower, shrub, rock or mineral in any such public
park, or to peel any bark from or cut or injure any tree in such public
park.
(4)
Fires: To light any fire for any purpose in any part
of any such public park except in a stove, oven or fire circle provided
for that purpose, or to deposit lighted matches, cigarettes, cigars,
burning tobacco or hot ashes where they may cause fires.
(5)
Garbage and refuse: To deposit garbage or refuse in
any place in such public park except in receptacles provided therefor
or to otherwise litter any such public park.
(6)
Dogs, cats and other animals: To bring or keep any
dog, cat or other animal in any part of any such public park, except
with written permission from the Board of Trustees of the Village
of East Aurora.

(7)
Hunting and trapping: To hunt or trap game within
the boundaries of any such public park, except with written permission
from the Board of Trustees of the Village of East Aurora.

Bathing and swimming: To bathe or swim in the waters
in any such public park except where and as prescribed by the rules
governing such bathing and swimming.
(9)
Gambling: To gamble in any such public park.
(10)
Horses and riders: To ride, walk or otherwise permit
any horse or other animal in any such public park, except with written
permission from the Board of Trustees of the Village of East Aurora.

(11)
Snowmobiles: To drive, ride on, operate or otherwise
have any snowmobile or other self-propelled vehicles in any such public
park except in areas designated for such vehicles and at designated
times.
(12)
Alcoholic beverages: To possess or consume alcoholic
beverages in any such public park, except by written permission from
the Board of Trustees of the Village of East Aurora.

(13)
Operation of motor vehicles: To operate a motor vehicle in violation of Chapter 249, Vehicles and Traffic, of the Code of the Village of East Aurora.

(14)
Commercial enterprise: To sell or offer for sale any
property or privilege whatsoever within any such public park except
by written permission from the Board of Trustees of the Village of
East Aurora.

(15)
To engage in golfing (the striking or hitting of golf
balls).

(16)
Smoking of any kind, whether tobacco products, marijuana, or
chemical combinations, including, but not limited to, cigarettes,
cigars, pipes, e-cigarettes, vaporizers (vaping), bongs, hookahs,
joints, water pipes of any nature, and any form of cannabis.

B.
Whenever written permission from the Board of Trustees
of the Village of East Aurora is required under this chapter, the
applicant therefor shall file a written application for such permission
with the Village Clerk, said application to be on forms prescribed
by the Village Clerk. The Board of Trustees shall be responsible for
issuing park permits, with such conditions and restrictions as the
Board, in its discretion, deems necessary.

Violations of any of the provisions of this
chapter shall be punishable by a fine of not more than $250 or by
imprisonment for not more than 15 days, or both. Each day's continuance
of a violation after notice shall be deemed a separate and distinct
violation and shall be punishable accordingly.

This chapter may be amended by resolution by
the Village Board of Trustees.
This chapter shall become effective November
18, 2002.
