The following chapter shall apply to the unincorporated areas of the
Town of Mount Pleasant.
All takeoffs or landings of helicopters or other aircraft from other
than approved areas are prohibited within the unincorporated areas of the
Town of Mount Pleasant.
A.
A violation of this chapter shall be a misdemeanor.
B.
A violation of this chapter shall be punishable as follows:
(1)
A person found guilty may be sentenced to 30 days in
jail or a fine of $500, or both, for a first offense.
(2)
A person found guilty of violating this chapter a second
time may be sentenced to up to 60 days in jail or fined up to $1,000, or both.
(3)
A person found guilty of a third violation and subsequent
violations of this chapter may be sentenced up to 120 days in jail or fined
up to $2,000, or both.
(4)
As provided in §§ 80.00 and 80.05 of the
Penal Law, in lieu of the foregoing schedule of fines, a fine equal to two
times the profit made as a result of such prohibited landing or takeoff may
be imposed.
Emergency landings are exempt from this chapter. However, in the event
of an emergency landing, no movement of the helicopter or other aircraft may
be made or permitted until such time as the proper administrative authority,
such as the Federal Aviation Authority, has certified or approved the movement
of the helicopter or other aircraft, which shall be removed by land to an
approved landing area where it may depart under proper supervision.
