Editor's Note: This local law also provided that, to the extent that it may conflict with applicable portions of the New York State Town Law, including § 62, it is the town's intention to exercise it's authority to supersede and amend, as granted under Municipal Home Rule Law § 10, and the town hereby provides notice that it is exercising said authority pursuant to Municipal Home Rule Law § 22.
By the adoption of this article, the Town of Newburgh declares its intent to regulate and amend the powers of the Supervisor to call special meetings, limited to one action item, on behalf of the Town Board. Reference is made to the Town Law of the State of New York, § 62, and the Municipal Home Rule Law of the State of New York, § 22, for legislative authority to so enact this article.
The words and phrases and definitions of words as used in the New York State Town Law shall be applied in the enforcement of this article.
Special meetings, limited to one action item, of the Town Board of the Town of Newburgh may be called by the Supervisor, by causing a written notice, specifying the time and place thereof, to be served upon each member of the Board personally at least one hour prior to the meeting; or by leaving a notice at his residence or place of business with some person of suitable age and discretion at least 24 hours before the time of the meeting or by mailing such notice to the residences of the members of the Board at least 72 hours before such meeting.
