A. 
Town Board. The construction, maintenance, operation and extension of the sewerage system of the duly constituted sewer districts of the Town of Newburgh to the point of connection therewith at the house or building line of any premises shall be subject to control and regulation by the Town Board of the Town of Newburgh.
B. 
Board of Health. Within said house or building line, the system of plumbing existing or proposed shall be subject to control by the Board of Health. The construction and maintenance of private systems of sewage disposal, existing or proposed, shall be subject to control and regulation by the Board of Health. "Board of Health," as used herein, is defined as the Town Board sitting as a Board of Health or the Orange County Health Department or any other body having jurisdiction superseding the Town Board sitting as a Board of Health.
C. 
Applicability. Articles I, II, VII, X, XI, XII, XIII, XIV, XV and XVI of this Part 1 shall apply in all incorporated areas of the town. Articles III, IV, V, VI, VIII and IX shall apply only in incorporated areas of the Town also within the service area of the POTW.
A. 
Established. There is hereby created a Town of Newburgh Sewer Department to be headed by the Sewer Department Superintendent or other designated Town officer or employee, who shall be responsible for the operation, management and functioning of such Department.
B. 
Superintendent. A Town Sewer Department Superintendent or other designated Sewer Department head shall be appointed by the Town Board and shall serve at the Board's pleasure and at a salary and on the terms and conditions as determined by said Board and shall be in charge of the Town Sewer Department.
C. 
Duties of Superintendent. The Sewer Department Superintendent or other designated officer or employee, as head of the Town Sewer Department, shall, on behalf of the Town Board, have general charge of the maintenance and operation of all of the public sewers within the Town of Newburgh and shall be responsible to the Town Board therefor. His duties shall include the following, in addition to those additional duties assigned to him from time to time by said Board. He shall:
(1) 
Keep complete records of the maintenance and operation of each sewer district.
(2) 
Issue all permits required relating to service as herein provided.
(3) 
Make reports to the Town Board when and as directed by the Town Board on forms prescribed by said Board of all activity of the Town Sewer Department, including moneys received, claims due and any other information as may be helpful to said Board in properly conducting the affairs of all of the sewer districts within said town.
(4) 
Assist the Town Board in the preparation of the annual budget, assessment roll and benefit or other formula for raising the necessary revenues for the operation of the various sewer districts.
(5) 
Supervise the installation and/or repair of all house or other building connections, testing procedures and shutting off and turning on of service and work with the Town Engineer as to any technical problems arising out of the operation of all of the public sewer systems.
