Subject to any of the other applicable provisions contained herein, upon written application for service by an owner or occupant of any property abutting on any public or private street and upon payment of the applicable charge for size of service and/or meter to be installed, as prescribed in Article XI, the Town will install (unless installation has already been completed pursuant to a main extension agreement or otherwise) the corporation tap and the appropriate size meter. It is further provided that easements acceptable to the Town must be furnished at the applicant's expense where necessary for all water service installations. All such service connections and all meters shall be and remain the property of the Town.
No hydrant shall be used for any purpose other than the extinguishing of fires, periodic tests of the fire-protection system or periodic drills by legally constituted fire companies. The Town shall be notified in advance of the time of all tests and drills so that, if desired, the Town may have a representative present. Such notification may be in writing or by telephone to the principal office and place of business of the Water Distribution Superintendent.
A. 
Upon application for private fire-protection service by an owner or occupant of any property abutting on any public or private street and upon payment of the applicable charge for the size service to be installed as prescribed in Article XI, the Town will install the corporation tap in both public and private streets.
B. 
If a hydrant is requested and installed for the purpose of private fire-protection service on a public or private street or on the owner's or occupant's property, the cost of installation of such hydrant shall be borne by the owner or occupant, who shall thereafter pay for such service according to the rates and charges prescribed in Article XI. The Town reserves the right to approve the type of hydrant and the manner of installation before service is provided.
C. 
Private fire-protection service shall be provided only by written agreement between the Town and the applicant therefor, which agreement shall contain the following express conditions:
(1) 
The connection is to be used for fire purposes only and is to have no connection whatsoever with any taps that may be used for other than fire purposes and, because of the danger of pollution, shall have no connection with any source of supply not approved by the Department of Health of the State of New York.
(2) 
The applicant specifically agrees not to draw any water whatsoever through said connection for any purposes except the extinguishing of fires or in a periodic test of the fire-protection system.
(3) 
Violation by the applicant of either condition in Subsection C(1) or (2) above shall terminate this agreement, and the Town may disconnect the pipe or shut off the supply of water.
(4) 
The applicant agrees to notify the Town at the time of all tests so that, if desired, the Town may have a representative present. Such notification, however, need not be formal or written but may be given by telephone to the principal office of the Water Distribution Superintendent.
(5) 
Any authorized representative of the Town shall have free access to the premises of the applicant at any reasonable time for the purpose of inspecting said connection.
(6) 
The applicant agrees to pay for services rendered under this agreement according to the rates and charges prescribed in Article XI. If at any time the applicant elects to change the terms of this agreement with respect to size of connection or number of fire-protection devices, this agreement shall be modified accordingly or a new agreement shall be executed. The charges set forth in Article XI are subject to change from time to time as rates may be modified.
(7) 
Water through said connection is to be supplied subject to the rights of municipal bodies to use water in the street mains through hydrants for fire purposes. The right is also reserved by the Town to shut off the supply at any time, without notice, in case of accident or to make alterations, extensions, connections or repairs. The Town makes no guaranty as to pressure of the water in said pipe or the main supplying the same and shall not, under any circumstances, be held liable for loss or damage from a deficiency or failure in the supply of water, whether caused by shutting off of water in case of accident or for alterations, extensions, connections or repairs or for any cause whatsoever unless arising from gross negligence.
Whenever service is temporarily disconnected, the owner-occupant will shut off service at the curb box, and, if the service is to be abandoned, the service will be shut off at the curb tap by the owner-occupant at his cost and expense.
A. 
At his own expense, the applicant shall install and maintain the service pipe from the corporation tap to the premises and two valves, the first to be located inside the building wall, the second valve adjacent to and on the house side of the meter, permitting control of the water supply. The valves shall be of a make and type approved by the Town. For this installation and maintenance thereof, the customer shall employ an approved plumber, and all work shall be performed in a manner satisfactory to the Town. The minimum size, materials, depth of cover and method of construction shall be the same as hereinafter specified. If any defects in workmanship or materials are found or if the customer's service has not been installed in accordance with such specifications or with the Town's requirements, water service either will not be turned on or will be discontinued if such defects are not remedied.
B. 
Service pipe and service connections shall not be trespassed upon nor interfered with in any respect. The curb stop may not be used by customers for turning on or shutting off water supply but is for the exclusive use of the Town.
All service pipes shall have a minimum cover of 4 1/2 feet. No service pipe shall be less in size than three-fourths-inch inside diameter if installed on and after April 1, 1969. United States Government Specifications Type K soft-tempered copper tubing shall be used on all services up to and including two inches in diameter, shall be approved by the Water Distribution Superintendent and of weight suitable for service under existing main pressure. All connections of service pipes to a main shall be made to the top of the main. The Town reserves the right in all cases to stipulate the size and type of service connections to be used.
A. 
An application and permit shall be obtained from the Water Department and approved by the Water Superintendent before any water service is installed.
B. 
A permit shall be obtained from the Town Clerk for any street excavating necessary in connection with the tapping of a main for a water service.[1] If excavating is to be done on a county or state road, it will be necessary to obtain a permit from the New York State Department of Transportation or the County Transportation Department.

C. 
All service from the main to the building shall be three-fourths-inch Type K copper, unless otherwise approved by the Water Superintendent. Each service shall have a curb stop and box located approximately 18 inches in front of the property line. Each curb box cover shall have the word WATER cast on it. The curb box shall be installed in such a manner so as to ensure the easy operation of the curb stop. Each service shall be installed with a minimum of four feet of earth cover.
D. 
A water meter of the type approved by the Town shall be installed on each and every service line at a location immediately inside the building which is warm enough to prevent freezing and at a location that is easily reached for reading and service. The meter shall become the property of the Town Water Department. Meters shall be AWWA approved and shall have an outside meter of the type approved for the water service installed. A gate valve shall be installed before and after the meter so that the meter can be removed for service. All meters of two inches or over shall have a bypass which will be sealed by the Water Department.
E. 
All excavations made in connection with water main or service connection installation shall be inspected and approved by the Water Department personnel prior to backfilling.
The Town shall not be required to install any service lines or service connections between November 15 and April 15, except by special arrangement, in which case the customer shall pay for the excess over normal costs.
