A.
Section 272-a of the Town Law of the State of New
York is hereby superseded in its application to the Town of Newburgh
with respect to the discretionary authority of the Planning Board
to prepare and change, advertise and hold public hearings on a Comprehensive
Master Plan for the development of the entire area of the Town. The
Town Board of the Town of Newburgh, rather than the Planning Board
of the Town of Newburgh, may prepare and change a Comprehensive Master
Plan for the development of the entire area of the Town, may advertise,
as required by Town Law § 272-a, and hold public hearings
thereon and shall file certified copies in the offices of the Planning
Board, the Town Engineer or Town Highway Superintendent and the Town
Clerk. The Town Board may, by formal resolution adopted after the
effective date of this chapter, delegate this authority to the Planning
Board.
B.
The document entitled "Master Plan, Town of Newburgh,
Orange County, New York," dated February 1991, adopted by resolution
of the Town Board on March 18, 1991, and on file at the office of
the Town Clerk, as it may be later amended, is hereby designated as
the present Comprehensive Master Plan of the Town of Newburgh. Town
Law § 272-a remains applicable to the Town of Newburgh in
all other respects.
