Enactment of this chapter is pursuant to § 10, Subdivision
1(i), of the Municipal Home Rule Law.
In order to protect the public safety of the residents of the Town of
Queensbury and to foster the general interest of its residents in a prudent
use of the lands and facilities of the town, the use and privilege of using
the town-owned dock located at Assembly Point, on Lake George, in the Town
of Queensbury, requires regulation and control by the Town Board of the Town
of Queensbury. Such regulation and control may be implemented or amended or
supplemented from time to time by resolution of the Town Board of the Town
of Queensbury not inconsistent with the provisions of this chapter.
All terms used herein for which definitions are established or provided for in Chapter 179 of the Code of the Town of Queensbury shall be so defined.
No person shall be entitled to use, cause to be used or permit to be
used the dock facility owned by the Town of Queensbury, located at Assembly
Point, on Lake George, in the Town of Queensbury, unless he or she has obtained
authorization from the Town Board of the Town of Queensbury.
The following individuals shall be exempt from § 70-4 and shall have access to the dock without having to obtain authorization from the Town Board of the Town of Queensbury:
A.
Employees of the Town of Queensbury Water Department.
B.
All valid easement holders or persons taking or obtaining
rights under, through or from said easement holders.
C.
Any agent or employee of the Town of Queensbury or other
person authorized by the Town Board to use said dock for Town purposes.
A.
A person who uses or permits or suffers the use of the dock who is not among the class of individuals listed in § 70-5, as provided by this chapter, who has not received authorization from the Town Board of the Town of Queensbury, or is otherwise in violation of this chapter, or any rule or regulation issued hereunder or who violates the provisions of § 70-6 hereof, shall be guilty of an offense and shall be punished by a fine not to exceed $250 for each separate such offense. Each day in which such a violation occurs shall be deemed to be a separate offense.
B.
In addition to the aforesaid penalties, the Town Board
of the Town of Queensbury may institute any proper action, suit or proceedings
to prevent, restrain, correct or abate any violations of this chapter.
