The City of Coatesville Planning Commission
is hereby reconstituted to consist of five members.
The Planning Commission shall perform all duties
and may exercise all powers conferred by law, by the Pennsylvania
Municipalities Planning Code (MPC),[1] and as requested by the Council of the City of Coatesville
consistent with the provisions of § 10209.1 of the MPC.
The City Council, by ordinance, by resolution or by other official
action, may confer powers and duties on the Commission which are consistent
with the provisions of the MPC.

A.
All members of the Commission shall be appointed by
the City Council of the City of Coatesville.
B.
The term of each of the members of the Commission
shall be four years or until his or her successor is appointed and
qualified, except that the terms of the members first appointed pursuant
to the MPC and this chapter shall be so fixed that no more than two
shall be reappointed or replaced during any future calendar year.
C.
The Chairman of the Planning Commission shall promptly
notify the City Council concerning vacancies in the Commission, and
such vacancies shall be filled for the unexpired term. If a vacancy
shall occur otherwise than by expiration of term, it shall be filled
by appointment for the unexpired term according to the terms of § 10203
of the MPC.

Attendance.

(1)
Any
member of the Planning Commission absent from three or more consecutive
regular meetings of the Planning Commission without an approved leave
of absence granted by the City Council after public hearing and prior
written notice thereof shall be removed from the Planning Commission
by the City Council of the City of Coatesville.
(2)
Any
member of the Planning Commission absent from 20% or more of the regularly
scheduled meetings of the Planning Commission within any one-year
period shall be notified in writing by the City Manager acting on
behalf of the City Council of the attendance requirements of this
subsection. Any member of the Planning Commission who is absent from
20% or more of the regularly scheduled meetings within a one-year
period shall thereafter be removed for cause from such position by
the City Council with prior written notice after public hearing unless
such member resigns in writing or waives the public hearing in writing.
(3)
Any
member of the Planning Commission may be removed for cause as determined
by the City Council after public hearing and prior written notice
thereof.
(4)
The
provisions of this subsection shall not preclude the removal of any
member of the Planning Commission without cause by the City Council
when authorized by state law, City Charter or City ordinance.
All acts of the existing Planning Commission
done heretofore are hereby expressly approved, ratified and confirmed
in all respects.
