The City of Coatesville hereby adopts, for the purpose of establishing rules and regulations for the construction, alteration, equipment, fire protection and safety of buildings and structures, including administration, building permits and penalties, the building code known as the "International Building Code," 2000 Edition, Inc., as published by the International Code Council, Inc., save and except such portions as are hereinafter deleted, modified or amended, of which three copies have been and are now filed in the office of the Codes Department, and the same are hereby adopted and incorporated as fully as if set out at length herein. From the date on which this article shall take effect, the provisions thereof shall be controlling in the construction of all buildings and structures, and in all other subjects therein contained, within the corporate limits of the City of Coatesville.
A. 
No fee shall be required for permits for repairs which involve the reconstruction or renewal of any part of an existing structure for the purpose of maintenance with a total cost valued at less than $250.
B. 
Permits shall be required for the construction, alteration, conversion, removal, demolition, repair and/or maintenance of any building or the addition to existing buildings. All persons desiring to perform such work shall make application for a permit for such work and shall pay, at the time of application, for the use of the City, the fee prescribed in Chapter 108, § 108-1C, of the Coatesville Code, based upon the value of the construction work. The Building Inspector shall have the right to verify or correct the estimate value or contract figures of such construction or work.
The building code hereby adopted is amended as follows:
A. 
Section 101.1, "Title," is amended to read as follows:
Section 101.1. Title. These regulations shall be known as the "Building Code of the City of Coatesville," hereinafter referred to as "this code."
B. 
Section 108.2, "Fee Schedule," is amended to read as follows:

Section 108.2. Fee Schedule. A fee for each plan examination, building permit and inspection shall be paid in accordance with the schedule of fees as established, from time to time, by ordinance of the City Council as set forth in Chapter 108 of the Code of the City of Coatesville pertaining to the schedule of fees and charges.
C. 
Section 113.4, "Violation Penalties," is amended to read as follows:

Section 113.4. Penalties.

Any person, firm or corporation who shall violate provisions of this code, or any provision of the International Building Code or who shall fail to comply with any requirement thereof, or who shall erect, construct, alter or repair a building or structure in violation of an approved plan or directive of the Codes Enforcement Officer or of a permit or certificate issued under the provisions of International Building Code shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000 and/or to imprisonment for not more than 30 days. Every day that a violation of the code or of the International Building Code continues shall constitute a separate offense.

Any person, firm or corporation who shall erect, construct, alter or repair a building or structure or who shall undertake any work or activity requiring a permit under this chapter or under the International Building Code without first obtaining the required permits and who shall be convicted under this Subsection B of failing to obtain the necessary permit shall be sentenced to pay a fine of up to $500 and/or to imprisonment for not more than 30 days and further shall pay two times the appropriate permit fee.
D. 
Section 114.3, "Unlawful Continuance," is amended to read as follows:

Section 114.3. Unlawful Continuance. Any person who shall continue any work in or about the structure after having been served with a stop-work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be, upon conviction, sentenced to a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days.[1]

In all matters that are regulated by the law of the Commonwealth of Pennsylvania or by regulations of departments or agencies of the Commonwealth promulgated by authority of law, such laws or regulations, or other ordinances of the City of Coatesville, as the case may be, shall control where the requirements thereof are the same as or in excess of the provisions of this article. The code shall control in all cases where the state requirements, or the requirements of other ordinances of this City, are not as strict as those contained in this article.
The provisions of this article so far as they are the same as those of ordinances and/or codes in force immediately prior to the enactment of this article, are intended as a continuation of such ordinances and codes and not as new enactments. The provisions of this article shall not affect any act done or liability incurred, nor shall they affect any suit or prosecution pending or to be instituted to enforce any right or penalty or to punish any offense under the authority of any of the repealed ordinances.
