The City of Coatesville hereby adopts, for the purpose of establishing rules and regulations for the design and installation of plumbing systems, including administration, plumbing permits and penalties, the Plumbing Code known as the "International Plumbing Code, 2000 Edition, as published by the International Code Council, Inc., save and except such portions as are hereinafter deleted, modified or amended, of which three copies have been and are now filed in the office of the Codes Department, and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this article shall take effect, the provisions thereof shall be controlling in the design and installation of plumbing systems within the corporate limits of the City of Coatesville.

The code hereby adopted is amended as follows:
A. 
Section 101.1, "Title," is amended to read as follows:
Section 101.1. Title. These regulations shall be known as the "Plumbing Code of the City of Coatesville," hereinafter referred to as "this code."
B. 
Section 106.6.2, "Fee Schedule," is amended to read as follows:
Section 106.6.2. Fee Schedule. The fees for all plumbing work shall be as indicated in the schedule of fees as adopted, from time to time, by ordinance of the City of Coatesville as set forth in Chapter 108 of the Code of the City of Coatesville pertaining to the schedule of fees and charges.
C. 
Section 108.4, "Violation Penalties," is amended to read as follows:

Any person, firm or corporation who shall violate any provision of this code or any provision of the BOCA National Building Code or who shall fail to comply with any requirement thereof or who shall erect, construct, alter or repair a building or structure in violation of an approved plan or directive of the Building Inspector or a permit or certificate issued under the provisions of BOCA National Building Code shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000 and/or imprisonment for not more than 90 days. Every day that a violation of the code or of the BOCA National Building Code continues shall constitute a separate offense.

Any person, firm or corporation who shall erect, construct, alter or repair a building or structure or who shall undertake any work or activity requiring a permit under this article or under the BOCA National Building Code without first obtaining the required permits and who shall be convicted under this subsection of failing to obtain the necessary permit shall be sentenced to pay a fine of up to $500 and/or to imprisonment for not more than 90 days and further shall pay two times the appropriate permit fee.
D. 
Section 114.3, "Unlawful Continuance," is amended to read as follows:
Section 114.3. Unlawful Continuance. Any person who shall continue any work in or about the structure after having been served with a stop-work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be, upon conviction thereof, sentenced to a fine of not more than $1,000, plus costs, or to a term of imprisonment not to exceed 90 days, or both such fine and imprisonment.
E. 
Section 305.6, "Freezing," is amended to read as follows:
Section 305.6. Freezing. Water service piping shall be installed below recorded frost penetration but not less than 36 inches below grade. In climates with freezing temperatures, plumbing piping in exterior building walls or areas subjected to freezing temperatures shall be protected against freezing by insulation or heat, or both.
F. 
Section 305.6.1, "Sewer Depth," is amended to read as follows:
Section 305.6.1. Sewer Depth. Building sewers that connect to private sewage disposal systems shall be a minimum of 36 inches below finished grade at the point of septic tank connection. Building sewers shall be a minimum of 36 inches below grade.
In all matters that are regulated by the law of the Commonwealth of Pennsylvania or by regulations of departments or agencies of the commonwealth promulgated by authority of law, such laws or regulations or other ordinances of the city, as the case may be, shall control where the requirements thereof are the same as or in excess of the provisions of this article. The code shall control in all cases where the commonwealth requirements or the requirements of other ordinances of this city are not as strict as those contained in this article.
The provisions of this article so far as they are the same as those of ordinances and/or codes in force immediately prior to the enactment of this article are intended as a continuation of such ordinances and codes and not as new enactments. The provisions of this article shall not affect any act done or liability incurred, nor shall they affect any suit or prosecution pending or to be instituted to enforce any right or penalty to punish any offense under the authority of any of the repealed ordinances.
