A.
The purpose for establishing College Hill parking
permits is to help alleviate parking congestion in the area surrounding
Lafayette College, the Cattell Street corridor, and the FA March School.
Such congestion results in unnecessary hardship to the area residences
and businesses.

B.
A resident vehicle on which is displayed a valid parking permit as provided for herein shall be permitted to be parked in the residential parking permit area for which the permit has been issued. However, such resident's vehicle shall be exempt from any time limit imposed but shall not be exempt from parking restrictions or prohibitions established pursuant to authority other than this article, including Chapter 560, Vehicles and Traffic, Article X, of the code of the City of Easton as well as loading, twelve-minute parking zones, handicapped zones, seventy-two-hour limit in any one space (then vehicle must be moved), and other special parking restrictions.

C.
A residential parking permit shall not guarantee or
reserve to the holder thereof an on-street parking space within the
designated residential parking permit area.
D.
Every resident with a valid Pennsylvania driver's
license from each dwelling unit in the area is eligible to receive
a permit. Each permit issued shall be good for one car only. The address
on the motor vehicle registration and driver's license shall match
that of the residence. Permits will be provided for one vehicle per
licensed driver per household.

E.
Every student resident, other than those living in a college-owned
or -managed residence hall, with a valid driver's license from each
dwelling unit in the area is eligible to receive a specially designated
student residential permit. In the event that the address on the motor
vehicle registration and driver's license does not match that of the
residence, a copy of the lease and permission from the college for
off-campus residency will be required. Each permit, good for one car
only, shall be issued for a one-year period only, from July 1 through
June 30. As stated a college or university student living on a mixed-use
residence hall, owned or managed by the college, is not eligible for
a College Hill Permit.

F.
Every business owner within the district, as well
as his/her employees, is eligible to receive a permit upon presentation
of proof of payment of business permit and/or occupational privilege
tax. Employee permits shall be good for one car only and shall be
issued for a one-year period only, from July 1 through June 30. The
Chief of Police will determine documentation required for proof of
employment.
G.
The program shall be reviewed in spring of 2007 and
every two years of operation thereafter by the ad hoc College Hill
Parking Committee and/or agents of the City as designated by the administration,
and written comments shall be forwarded to the administration and
Council.

Additionally, within the College Hill Parking Permit Zone, a third
Commercial District Limited Parking Time Zone will also be created.
This zone will be an area bordered by Clinton Terrace to the south,
Reeder Street to the east, High Street to the north and McCartney
Street to the west. Parking affected by a two-hour time limit will
be on both sides of said streets. Vehicles parked within this zone
will be limited to two-hour parking unless a valid residential parking
permit is displayed on the vehicle. The residential parking permit
restriction from 2:30 a.m. to 6:30 a.m. will also be applicable in
this zone.
A.
The area affected by the College Hill Parking Program
includes all public streets within the area bordered by Bushkill Drive
to the west; Lafayette Street on the north going east to Pardee, north
on Pardee to Chestnut Terrace; east on Chestnut Terrace to Knox Avenue,
east on Knox to Cattell; south on Cattell to Lafayette; east on Lafayette
to Paxinosa Avenue; Paxinosa south to High Street; High Street west
to Reeder Street; Reeder Street south to Clinton Terrace; Clinton
Terrace west to Cattell Street; Cattell Street south to College Avenue;
and College Avenue south to meet at Bushkill Drive, including both
sides of all the border streets. The area does not include the Lafayette
College campus proper.
B.
Within
the College Hill Residential Parking Permit Zone, a FA March School
Impact Zone will be created. This zone will be an area comprised of
the north side of Monroe Street from Porter Street to Brodhead Street;
the south side of Monroe Street between Porter and Reeder Streets
and between Brodhead Street and Paxinosa Avenue; the east side of
Reeder Street between Pierce and Monroe Streets; the west side of
Reeder Street between Monroe and Parson Streets; and the west side
of Brodhead Street between Pierce and Monroe Streets.

C.
The Lafayette College campus proper shall be defined
for the purposes of this article as the Lafayette tax parcels bounded
by Bushkill Drive and Deitrich Road to the west; by Pierce Street
to the north, to the east by Hamilton Street from Pierce to Parson,
Parson from Hamilton to McCartney, McCartney from Parson to College
Avenue and to the south by College Avenue to Bushkill Drive.
D.
City of Easton parking permits will be valid within
the entire area.
F.
Where so designated in the City's Traffic Code, no
vehicle shall remain parked between the hours of 2:30 a.m. and 6:30
a.m. without displaying a valid College Hill Parking Permit, with
the exception of the periods between May 15 and August 15, December
23 and January 15, Thanksgiving Day to the Sunday immediately following
Thanksgiving. Within the FA March School Impact Zone, no vehicle shall
remain parked between the hours of 2:30 a.m. and 8:30 a.m. without
displaying a valid College Hill Parking Permit, with the exception
of the periods from June 1 to August 15 or when school is not in session.

G.
Within the College Hill Residential Parking Permit
Zone a second Kirby Sports Center Limited Time Parking Zone will also
be created. This zone will be an area bordered by Pierce Street to
the south, Pardee Street to the west, McCartney Street to the east,
and Burke Street to the north. Parking spaces affected will include
those on the north side of Pierce Street from Pardee to McCartney
Street, and both street sides of Pardee, McCartney and Burke and those
streets within the defined area. Vehicles parked within this zone
will be limited to two-hour parking unless a valid residential parking
permit is displayed on the vehicle. The residential parking permit
restriction from 2:30 a.m. to 6:30 a.m. will also be applicable in
this zone.
H.
The program may be expanded to contiguous areas by
square block. A block may be considered as a potential residential
parking block upon receipt by the City of petitions from the residents
thereof. At least 50% of the property owners must petition for consideration.
A.
Eligibility. Parking stickers may be issued to each
residential dwelling unit and to each place of business in the area.
B.
Permit application issuance and duration.
(1)
Following Council's approval of the designation of
a residential parking permit area, the Chief of Police shall issue
appropriate permits and shall cause parking signs to be erected in
the area indicating the times and conditions under which parking shall
be allowed.
(2)
A permit shall be issued upon application and payment of any applicable
fee only to the eligible owner or operator and verification that all
outstanding parking fines/fees have been satisfied for any and all
vehicles of the owner.

(3)
Each residential parking permit issued shall be valid
for the term of residency at the address provided upon application.
Student residential parking permits issued shall be valid for a one-year
period only from July 1 through June 30.
(4)
Each application for a parking permit shall contain
information sufficient to identify the applicant, his residence address
of real property owned or leased within the eligible area, and the
license number of the motor vehicle for which application is made,
and such other information that may be deemed relevant by the Chief.
Specifically, eligibility for a permit shall be as follows: the person
shall prove residency and vehicle ownership or evidence of having
a leased or company-owned vehicle. The Chief of Police shall establish
criteria for proof of residence, which shall include, but not be limited
to, proof of payment of the per capita tax, if applicable.
(5)
If a resident sells or otherwise transfers a vehicle
bearing a parking permit sticker, (s)he shall remove the sticker before
the transfer. If a resident transfers a vehicle bearing a valid parking
permit sticker and acquires another vehicle, (s)he shall provide the
Chief with proof of the transfer and an affidavit attesting to the
removal of the sticker. The Chief shall then provide, at no cost,
a new sticker which shall expire at the same time as the original
sticker. Application for the new vehicle's permit must be made within
10 days of vehicle purchase.

Commercial vehicles exceeding a gross weight of 10,000
pounds are not eligible for permits.
C.
Permit display. Permits shall be displayed on the
driver's side of the rear bumper, or in the left lower corner of the
rear windshield, so as to be readily visible to enforcement personnel.
D.
Permit revocation. The Chief is authorized to revoke
the parking permit of any person found to be in violation of this
article, and upon written notification thereof, the person shall surrender
such permit to the Chief. Failure, when so requested, to surrender
the parking permit so revoked shall constitute a violation of law
and of this article. When permit holders change employment or relocate,
the issued permit shall become invalid and such permit shall be immediately
surrendered to the Chief.
E.
Guest permits. One guest permit will be available
for each dwelling unit occupied by a permanent permit holder, and
will show the address for which it is issued, and will only be valid
within a one-block radius of that address. Guest permits will be four
inches by six inches and placed in the lower left corner of the rear
window. Additional temporary guest permits will be available to all
permit holders at the discretion of the Chief of Police.
A.
This program does not guarantee the availability of
on-street parking spaces.
B.
All other parking requirements shall remain in full
effect.
C.
Permits can be obtained between the hours of 8:00
a.m. and 3:30 p.m. Monday through Friday, except holidays, from the
Traffic Division of the Easton Police Facility or at other times and
places established by the Chief of Police. The permit shall be issued
after the following documents have been presented to the Clerk:
(1)
Driver's registration card;
(2)
Vehicle registration card (lease and/or company cars
may be registered to another address);
(3)
Proof of payment of per capita tax or occupational
privilege tax indicating address within the designated area;
(4)
Completed application;
(5)
Valid use and occupancy permit for business application;
(6)
Valid lease for apartment within the designated area;
and
(7)
If application is made for a student resident permit,
a letter from Lafayette College permitting off-campus residential
status.
D.

A.
For a violation of any provisions of this article, the owner or operator may, within seven days of the time when such notice was attached to his/her vehicle, pay a penalty as specified in Chapter 285, Fees.

C.
Penalties may be waived for residents during the first
30 days of the program, providing they show proof of meeting the residency
requirements on the date(s) of the violation(s) and apply for and
receive a valid permit.
D.
Penalties may be waived for residents moving into
the designated area within 10 days of their move, provided they show
proof of meeting the residency requirements on the date(s) of the
violation(s) and apply for and receive a valid permit.
E.
No person shall falsely represent himself as eligible
for a parking permit or to furnish information in an application thereof.
F.
No person holding a valid parking permit issued pursuant
hereto shall permit the use or display of such permit on a motor vehicle
other than that for which the permit is issued. Such conduct shall
constitute an unlawful act and violation of this article both by the
person holding the valid parking permit and the person who so uses
or displays the permit on a motor vehicle other than that for which
it is issued.
G.
No persons shall copy, produce or otherwise bring
into existence a facsimile or counterfeit parking permit or permits.
No person shall knowingly use or display a facsimile or counterfeit
parking permit in order to evade time limitations on parking in the
permit area.
H.
Every person convicted of a summary offense for a
violation of any of the provisions of this article for which another
penalty is not provided shall be sentenced to pay a fine of $300 plus
costs.
