The Ulster County Legislature does hereby find that existing refuse disposal sites within the County are becoming seriously depleted and that such depletion results in a significant hazard to the health, safety and welfare of the residents of the County. It is the purpose and intent of this article to regulate the use of refuse disposal sites in Ulster County by eliminating disposal in Ulster County of refuse originating without the County and thereby promote the longevity of existing disposal sites as well as any which might hereafter be developed within the County.

As used in this article, the following terms shall have the meanings indicated:
CONSTRUCTION AND DEMOLITION DEBRIS
Uncontaminated solid waste resulting from construction, remodeling, repair and demolition of utilities, structures and roads, and uncontaminated solid waste resulting from land clearing.

DREDGE MATERIAL
Sediment, soil, mud, sand, shells, gravel, other aggregate, earth, rock, sludge or other matter dredged or otherwise removed or excavated from the Hudson River or any other body of water.

GARBAGE
Solid or liquid waste.
INDUSTRIAL WASTE
Solid or liquid material resulting from construction or any business, trade or industrial operation.
REFUSE
Regulated waste, construction and demolition debris, garbage, rubbish, industrial waste and dredge material.

REFUSE DISPOSAL AREA
Land used for the deposit of refuse.
REGULATED WASTE
Concrete, brick, asphalt, asbestos, drywall, plaster, roofing materials, wood, metal, tiles, paint chips, ash, slag, coal, pieces of particle board, carpet, petroleum contaminated soil, and other contaminate materials.

No refuse originating as such outside the County of Ulster, or which has been collected or otherwise obtained outside the County of Ulster and transported or otherwise delivered within said County, shall be deposited, or caused or allowed to be deposited, in any refuse disposal area within the County of Ulster.
This article shall not prohibit the continued operation of any refuse disposal areas within the County of Ulster which are being lawfully used in whole or in part on the effective date of this article for the deposit of refuse described herein in ยงย 304-3; provided, however, that the deposit of such refuse subsequent to the effective date hereof in quantities greater than 60 tons per calendar week or on sites greater in area or other than those for which operating permits have already been granted by the New York State Department of Environmental Conservation prior to the effective date hereof shall constitute a violation of this article.
A.ย 
Each violation of, or nonconformance with, any provision of this article shall constitute a misdemeanor punishable by a fine of not more than $2,000 or by imprisonment for not more than six months, or by such fine and imprisonment.

B.ย 
The County Attorney of Ulster County is authorized to commence an action in any court of competent jurisdiction to enjoin any violation of this article.
