There shall be a personnel system covering all persons employed by the Town, with the exceptions provided in § C-121, which shall be under the jurisdiction of the Personnel Board and which shall be organized to achieve the following objectives:
A. 
Town government shall provide equal employment opportunities that are free of personal and political considerations and are in conformity with federal and state laws governing nondiscrimination in employment.
B. 
The Town Council may execute, at its sole discretion, written employment agreements of up to three years in duration with any of its employees, consistent with the efficient operation of Town government.
C. 
All jobs will be evaluated and job descriptions prepared in order to establish a consistent basis for measuring and ranking similar jobs.
D. 
Appointments, promotions and other actions requiring the application of merit shall be based on necessary qualifications, performance evaluations, and seniority if two or more candidates are judged to be equally qualified.
E. 
To insure effective working relations, fair administration of the personnel system shall be conducted in consideration of the rights and interests of employees, consistent with the best interests of the public and the Town.
F. 
Tenure of employees covered by the personnel system shall be subject to good behavior, satisfactory job performance, the availability of related Town funds, and continuation of the position.

There shall be a Personnel Board consisting of five members appointed by the Town Council. No member of the Personnel Board shall be employed by or be an official of the Town, nor shall be a member of any local, state or national committee of a political party or an official or member in any partisan political club or organization, nor shall hold or be a candidate for any elective office. Each member of the Personnel Board shall serve a three-year term, and the terms shall be on a staggered basis. Members shall serve conditioned only upon good behavior and shall be removed only for cause. Vacancies occurring during a term shall be filled by the Town Council for the balance of the term. Members of the Board shall serve without compensation, but funds will be provided for reasonable and necessary expenses.

It shall be the duty of the Personnel Board to:
A. 
Advise the Town Council on matters of personnel policy as requested by the Town Council.
B. 
Advise the Town Manager on matters of personnel administration.
C. 
Advise the Town Council and the Town Manager in the development of a Personnel Ordinance, of personnel rules, a job classification plan, a uniform pay plan, and the recommendations to be made by the Town Manager under Subsection E of § C-85.
D. 
Represent the public interest in the improvement of personnel administration in the Town service.
E. 
Make any inquiry which it may consider desirable concerning personnel administration in the Town service and make recommendations to the Town Council with respect thereto.
F. 
Send, in writing, to the Board of Canvassers any proposed changes in compensation for Town Council and School Committee members. Any such change shall become effective only upon approval of the voters of the Town at a general or special election.
G. 
To perform such other duties as may be requested by the Town Council or required by ordinance.
The personnel system will be administered by the Town Manager.
A. 
The Town Manager shall administer the personnel system as now or hereafter set forth in the Charter or by ordinance.
B. 
The Town Manager shall prepare such personnel reports and provide such personnel information as is directed by the Personnel Board.

The personnel system shall include all positions in the Town except as follows:
A. 
All elected officials and members of boards and commissions.
B. 
Town Manager, Town Solicitor, Probate Judge, Municipal Court Judge, Town Sergeant.
C. 
Employees of the School Department.
D. 
Volunteer personnel and personnel appointed to serve without pay.
E. 
Consultants and counsel rendering temporary professional service.
F. 
Such other positions as may be excepted by ordinance or this Charter.
