The Building Code of the Town shall be the Rhode Island State Building Code, as adopted and as amended from time to time.

A. 
The fire limits in the Town are hereby established as being bounded and described as follows:
(1) 
Beginning at a point formed by the intersection of Division Street with Peirce Street and thence running easterly along Division Street to its intersection with Marlborough Street; thence running southerly along Marlborough Street to its intersection with Long Street; thence running easterly along Long Street to the New York, New Haven and Hartford Railroad right-of-way; thence running southerly along the west side of the said right-of-way to London Street; thence running westerly along London Street to its intersection with Marlborough Street; thence running southerly along Marlborough Street to its intersection with Rocky Hollow Road; thence running westerly along Rocky Hollow Road to its intersection with Upland Avenue; thence running southerly along Upland Avenue and the prolongation of Upland Avenue to its intersection with Greenwich Boulevard; thence continuing southerly along Greenwich Boulevard and westerly along Greenwich Boulevard to its intersection with Post Road; thence running southerly along Post Road to its intersection with Cedar Avenue; thence running westerly along Cedar Avenue to a point formed by the intersection of the prolongation of Second Street; thence running northerly along the prolongation of Second Street and Second Street itself to its intersection with First Avenue; thence running westerly along First Avenue to its intersection with Cliff Street; thence running northerly along Cliff Street to its intersection with Friendship Street; thence running westerly along Friendship Street to its intersection with William Street; thence running northerly along William Street and the prolongation of William Street to its intersection with Somerset Street; thence running easterly along Somerset Street to its intersection with Liberty Street; thence running northerly along Liberty Street to its intersection with Peirce Street; thence running northerly along Peirce Street to its intersection with Division Street and the point of beginning; for the purpose of this description the lines referred to above along the roads, streets and avenues shall be the respective center lines.
B. 
In addition to the foregoing, all properties in the Town located easterly of the above-described fire district and zoned Commercial Downtown - CD-1 and CD-2 or M/LIO shall be included within and constitute a part of the fire district.
C. 
Also, the fire limits shall contain all of the land laid out and delineated as Lot Nos. 1 and 115 on Assessor's Plat 6 of the Tax Assessor's records as appears of record on December 31, 1967.
D. 
Also, in addition to the foregoing, all properties in the Town zoned or used for commercial or industrial purposes shall be included within and constitute a part of the fire district in which only structures of Type 1, 2 or 3 construction shall be erected or constructed.
The provisions of this chapter shall not apply to property owned by the Town, the state or the United States.

Building permit fee schedule.
(1) 
Fee schedule: determined by the State of Rhode Island.
B. 
Electrical, plumbing and mechanical permit fee schedule.
(1) 
Fee schedule: determined by the State of Rhode Island.
(2) 
Late filing fee: $275 or 50% of the required permit fee, whichever is greater.
(3) 
Reinspection fee: $55.
(4) 
CE/ADA state fee not included.

Any person seeking a building permit shall first submit a site plan with the following information:
A. 
Location of the main structure, relative to all property lines.
B. 
Location of all accessory structures relative to all property lines and main structure.
C. 
Maximum groundwater elevation and/or depth, as reported on the individual sewage disposal system for the lot.
D. 
Maximum depth and elevation of the bottom of the foundation.
E. 
Location of any wetland as designated in accordance with the General Laws.
F. 
Location of a fixed convenient bench mark on the property.
G. 
The elevation of the road in front of the proposed dwelling unit.
H. 
A site grading plan if the proposed first floor is lower than the elevation of the public highway.
I. 
A site grading plan if the driveway, at any point, is lower than the street elevation.
J. 
A site grading plan if the garage floor elevation is lower than the street elevation.

A. 
Definitions. As used in this section unless the context otherwise indicates:
BUILDING OFFICIAL
The Building Official of the Town of East Greenwich.
BUILDING PERMIT FEE
The fee imposed by § 38-4 of this chapter or any amendment thereto and shall include any fee for signs.
HISTORIC DISTRICT or HISTORIC STRUCTURE
As described and determined in Article XI (Historic Districts) of Chapter 260, Zoning, of the Code of the Town of East Greenwich and all amendments thereto.
B. 
Waiver of building permit fee. The Building Official shall waive the building, plumbing, mechanical and electrical permit fees for reconstruction, replacement, renovation or restoration to existing structures within the Historic Districts or to existing historic structures within the Town of East Greenwich. However, the requirement for a building permit or other required permit, adherence to the State Building Code and any review required under Chapter 260, Article XI (Historic Districts), are not waived. This section shall not be applicable to other types of construction within the Historic Districts. No building permit fee shall be waived unless the application for same is made following the passage of this section. Waiver of fees under this section shall not exceed $750 per property.[1]

C. 
Zoning compliance. The provisions of this section shall not apply in any case where there has not been compliance with Chapter 260, Zoning, of the Code of the Town of East Greenwich.
Violations of the provisions of this chapter shall be punishable as provided in Chapter 1, Article III, of the Code of the Town of East Greenwich.
