This article shall regulate and control the use of a municipal waste disposal area for purposes of promoting the public health, welfare, safety and benefit of the inhabitants of the Town.
It shall be unlawful to deposit any waste at a municipal waste disposal area without a dumping permit issued in accordance with this article.
It shall be unlawful to deposit any garbage, sludge or large noncombustible waste at a municipal waste disposal areas without a special permit issued in accordance with this article. Special permits shall be issued by the Town Council upon application and consultation with the Director.
A. 
The Director shall accept applications and issue dumping permits to all residents seeking the use of any municipal waste disposal area.
B. 
Nonresidents seeking permits shall clearly establish that waste originates within the Town. The Director may deny the issuance of a nonresident permit application if he feels the applicant has not clearly established proof that waste shall originate within the Town.
C. 
The Director shall file, at least annually, a detailed report with the Town Council concerning all permits issued, fees collected and disposal area conditions.
D. 
The Director may, with approval of the Town Council, rescind any permit previously issued if the provisions of this article are being violated by the permittee.
Fees to be charged for all dumping permits issued pursuant to this article shall be as follows:
A. 
Automobiles or utility trailers: no fee.
B. 
Any vehicle with commercial motor vehicle registration plates or camper registration plates, and with up to three-fourths-ton carrying capacity, without integrated compaction equipment, shall be allowed to dump 12 loads of waste per calendar year at no fee. Any waste deposited beyond 12 loads per year shall be charged in accordance with the fee schedule in Chapter 93, Fees.
C. 
Special permits: fee established by the Town Council according to use.
A. 
It shall be unlawful for any person to deposit any building demolition materials from a truck with a carrying capacity greater than 1/2 ton at the waste disposal area.
B. 
It shall be unlawful for any person to deposit brush from a truck with a carrying capacity greater than 1/2 ton at the waste disposal area, unless such brush is reduced in size by a mechanical chipper.
The Town Council shall from time to time establish and post rules concerning the time and procedure for depositing of waste at any municipal waste disposal area.
It shall be unlawful for any person to deposit any waste originating outside the Town at a municipal waste disposal area.
It shall be unlawful for any person to deposit any waste at a municipal waste disposal area at times other than the hours posted, unless deposits are made in authorized containers posted for off-hours use.
It shall be unlawful for any person to ignite or salvage any waste at a municipal waste disposal area.
It shall be unlawful for any person to possess firearms at a municipal disposal area unless authorized by the Police Chief.
It shall be unlawful for any person to deposit waste at a municipal waste disposal area in a manner not in accordance with rules established and posted by the Town Council.
It shall be the duty of the Chief of Police to enforce the provisions of this article.

Violations of the provisions of this article shall be punishable as provided in Chapter 1, Article III, of the Code of the Town of East Greenwich.
