Town of Johnston, RI Article III Open Containers

§ 91-7 Consumption in public prohibited.

No alcoholic beverage shall be consumed on Town streets and sidewalks or within public parks and recreational facilities. It shall be unlawful for any person to possess, consume from and/or transport any open container containing alcoholic beverages on any public street, public sidewalk or public way.

§ 91-8 Exceptions.

Persons attending events sponsored by private, civic and/or charitable organizations, which have special licenses for the sale or service of alcoholic beverages, shall be excluded from the provisions of this article so long as said persons:

A. Are located on the licensed premises while possessing, consuming or transporting alcoholic beverages; and

B. Have purchased the alcoholic beverages from the organization duly licensed to sponsor said event.

§ 91-9 Violations and penalties.

Any person charged with a violation of the provisions of this article shall be required to appear at the Johnston Municipal Court to answer said charge. Any person found to be in violation of the provisions of this article shall be punished by a fine in the amount of $100.
