GENERAL REFERENCES

Any and all day-care centers or facilities (as defined in § 340-4 of the Johnston Town Code) in any zoning district that abuts a residential zone within the boundaries of the Town shall have play yards completely enclosed with stockade or some other form of fencing of an opaque character which shall have a minimum height of four feet or as set by the Rhode Island Department of Children, Youths and Their Families (DCYF).
Said fencing shall be of an opaque nature and sufficient to provide for the safety of the children housed therein. Said fencing shall be of a nature to prevent injuries to the children therein as well as a safe and protective environment from intruders and traffic concerns.
Any and all new applications for licensing shall be conditioned upon compliance with the provisions of this article.
All existing licensed day-care facilities within the Town of Johnston shall meet the requirements of §§ 147-1 through 147-3 above or may modify existing chain-link-type fencing with inserts of vinyl or other material as necessary to ensure the health, safety and well-being of the residents and children serviced at the facility. Said material shall provide approximately 75% opaque coverage.
