It shall be unlawful for any person to dig or excavate any trench to a depth in excess of six feet and a width of less than five feet without providing adequate shoring, barriers, or other suitable support to protect the excavation or trench from cave in.
If any excavation to be made in the Town shall be intended to be in excess of six feet in depth and less than five feet in width, the person intending to do such excavation shall obtain a permit to so excavate from the Building Inspector or the Deputy Building Inspector, for which there will be a charge of $1, and it shall be the duty of the Building Inspector to require upon such permit the safeguards required under the terms of this article.
All persons applying for a permit to construct a trench or an excavation governed by the provisions of this article shall submit to the Building Inspector a plan or sketch of such excavation at the time of application for such permit.
This article shall be enforced by and in the name of the Building Inspector or the Deputy Building Inspector, and any fines recovered for violations of this article shall be paid over to the Town.
Anyone convicted of a violation of any of the provisions of this article shall be punishable as provided in Chapter 1, General Provisions, Article II, of this Code.
