For the purpose of protecting the inhabitants of the Town from the dangers incidental to the operation, installation and maintenance of oil- and gas-burning burners and equipment, and for the preservation of the health, safety and welfare of the inhabitants, this chapter is enacted.
Where the circumstances or conditions of any particular installation are unusual and such as to render the strict application of this chapter impracticable, the Plumbing Inspector may permit such modifications as will provide a substantially equivalent degree of safety.
The Plumbing Inspector or Deputy Plumbing Inspector may make such further rules and regulations pertaining to this chapter as in their discretion will best serve to further the purpose of this chapter. All such rules and regulations, including the setting of fees and charges for permits, shall be submitted in writing to the Town Council for approval and upon approval by Town Council shall become a part of this chapter.
A. 
The Plumbing Inspector or Deputy Plumbing Inspector shall be notified of the commencement of any oil- or gas-burning installations or any oil or gas piping work to be used with any oil or gas heating device, and shall be notified when such work is completed or ready for inspection.
B. 
All such notices shall be in writing and shall be part of the official record of the application and permit, and the application for final inspection of the work done under the permit shall be filed in the office of the Plumbing Inspector or the Deputy Plumbing Inspector by the party obtaining the permit, within 48 hours after the work is completed.
If any oil or gas heating apparatus, installations or piping shall be installed contrary to the provisions of this chapter, the owner, general contractor, supervising engineer or architect and master plumber shall all and severally be deemed to be in violation of this chapter and subject to the penalties provided in § 230-6, regardless of the time of commencement and completion.
A. 
Any person who shall violate any provision of this chapter shall be guilty of a misdemeanor and upon conviction thereof shall be punished as set out in Chapter 1, General Provisions, Article II.
B. 
The Plumbing Inspector or the Deputy Plumbing Inspector shall have the right to order the removal of any violation of oil or gas heating apparatus units or piping incidental thereto which has not been installed upon proper permit or does not conform to the requirements of this chapter. If any person ordered to remove any heating device or incidental piping shall refuse to obey the order of the Plumbing Inspector or the Deputy Plumbing Inspector, then in that event the Plumbing Inspector or Deputy Plumbing Inspector shall be authorized to have any unapproved or defective installation removed and recover the costs for same from the person obtaining the permit or the owner of the premises wherein such installation has been made contrary to the provisions of this chapter.
C. 
The Plumbing Inspector or the Deputy Plumbing Inspector may institute any legal action necessary to enforce the provisions of this chapter in any court having proper jurisdiction of the particular case and such action may be brought by and in the name of the Plumbing Inspector or Deputy Plumbing Inspector. All fines and revenues recovered in any such action shall be paid over to and be for the use of the Town.
