A. 
Purpose. This section is designed to provide regulation of amusement arcades or places where six or more coin-operated mechanical or electrical amusement devices are situated, or where one or more such devices is situated within 1,000 feet of a school entrance.
B. 
License required. No person who is the owner, lessor or operator of any premises in the Village shall operate on any premises in the Village six or more amusement machines, devices, electrical or mechanical games without receiving an amusement arcade license, which license shall be issued by the Village Board on an annual basis, subject to renewal the first day of July each year.
C. 
License fee and application.
(1) 
An annual premises license fee of $50[1] shall be submitted along with a license application to the Village Clerk, who shall forward the same to the Village Board for its consideration. The Village Board shall take into consideration, in determining the issuance or renewal of such license:
(a) 
The location of the premises and the suitability of the premises with regard to proximity to other businesses, residences, churches and schools;
(b) 
The zoning of such premises;
(c) 
The proposed supervision of such premises;
(d) 
The hours during which such machines, devices or games are open to use;
(e) 
The minimum proposed age of users;
(f) 
The number and type of machine, device or game;
(g) 
Other uses of the premises;
(h) 
Whether the premises have become a source of rowdiness or vandalism in the neighborhood, a source of frequent complaints to the police, or in other ways disruptive of the peace and order in the community; and
(i) 
Such other concerns as may be appropriate.

(2) 
Prior to the issuance of any renewal, the Village Board shall receive a report from the Law Enforcement Department setting forth any problems or difficulties that may have resulted from the licensed premises.
D. 
License restricted. Amusement arcade licenses issued under this section shall be restricted in nature. Such license shall be limited to the terms upon which it is granted and such terms shall be clearly set out on the face of the license and may include:
(1) 
Restrictions respecting hours during which the machines, devices, or games are open to use;
(2) 
The minimum age of users;
(3) 
The number and age of supervisory personnel required to be on the premises while the premises' machines, devices, or games are open to the public;
(4) 
The number and type of machine, device, or game;
(5) 
Other uses of the premises; and
(6) 
Such other limitations or restrictions as may be reasonable.
E. 
Amusement arcade licenses shall be procured by the person in control of the premises.
F. 
Any premises where three or more machines are installed or where one or more machines are installed within 1,000 feet of the entrance of a school shall obtain a license under this section prior to the issuance of an occupancy permit by the Building Inspector or an amusement device tag from the Village Clerk.
A. 
Definitions. As used in this section, the following terms shall have the meanings indicated:
AMUSEMENT DEVICES
Any coin-operated machine commonly referred to as shooting (electric ray) games, bowling games, ski-ball games, baseball games, shuffleboard games and other similar devices whether or not operated by coins, the operation of which involves a skill feature, and which do not deliver, pay out, or emit coins, tokens, coupons, tickets, receipts, chips, or other things, which may be redeemed, or exchanged for money, merchandise or other thing of value and in the operation of which the skill of the player is not subject to being thwarted by chance, including shuffleboard, billiard and pool tables whether or not coin-operated.
DISTRIBUTOR
Any person who as owner or lessor distributes or leases any amusement device to any person for use in the Village.
B. 
Licensing of amusement device distributors.
(1) 
Registration of amusement devices required. Any person who has possessory control of any premises in which is located any amusement device available for play shall register each and every such device with the Village Clerk.
(2) 
Registration fees.
(a) 
The registration fee for amusement devices shall be as follows:[1]

For each amusement device operated by a coin of five cents or more shall be $15 per annum.

For each amusement device operated by a coin of a value of less than five cents shall be $2.50 per annum.

(b) 
Such registration fee shall be paid to the Village Clerk at the time of registration.
(3) 
License to be displayed. If the Village Clerk is satisfied that the amusement device is entitled to be registered, a license shall be issued to the registrant for each device registered which shall be conspicuously displayed with any other licenses issued to such registrant.
(4) 
Application. The registration application shall show the ownership of the device for which registration is sought. If the registrant does not own the device so registered the owner of the device shall permanently affix a tag or similar item showing the owner's name and address.
(5) 
Such registration shall remain effective until the 30th of June following issuance, and on the first of July of each year thereafter each device shall be reregistered.
(6) 
The license shall not be transferable.
(7) 
No person shall have on any premises under possessory control any unregistered amusement device available for play.
C. 
Police officer may seize gambling device. Any police officer or special investigator of the Village may seize or cause to be seized any gambling device, slot machine or any amusement device upon which there is not affixed a registration symbol as herein required and may deliver the same into the custody of the Chief of Police.
D. 
Counterfeiting registration symbol prohibited. No person shall counterfeit a registration symbol or transfer a registration symbol from one amusement device to another, nor make any false statement in any application for a license or registration.
E. 
Penalty. Any person who violates any provision of this section shall, upon conviction, be subject to a penalty as provided in § 113-3 of this chapter and shall be disqualified from registering any further amusement devices for the current year.

Any person who violates any provision or any rule or regulation of this chapter shall be subject to a penalty provided in Chapter 1, General Provisions, § 1-19, of this Code.
