As used in this article, the terms "alcohol
beverages," "Class A license," "Class B license," "Class C license,"
"Class A retailers," "Class B retailers," "Class C retailers," "intoxicating
liquors," "wine," "principal business," "legal drinking age," "premises,"
"sell," "sold," "sale," "restaurant," "club," "retailer," "permit,"
"license," "hotel," "person," "fermented malt beverages," "wholesaler,"
"retailer," "operators" and "nonintoxicating beverages" shall have
the meaning given them by Ch. 125, Wis. Stats., and as hereafter amended.
A.
Wholesalers. No premises for which a wholesale intoxicating
liquor or fermented malt beverages permit has been issued may remain
open for the sale of intoxicating liquor or fermented malt beverages
between the hours of 5:00 p.m. and 8:00 a.m., except on Saturday the
premises may remain open until 9:00 p.m.
B.
"Class A" retailers. No premises for which a "Class
A" license or permit has been issued may remain open for the sale
of intoxicating liquor or fermented malt beverages between the hours
of 9:00 p.m. and 8:00 a.m.
C.
"Class B" and "Class C" retailers. No premises for
which a "Class B" license or permit or a "Class C" license has been
issued may remain open between the hours of 2:00 a.m. and 6:00 a.m.,
except as otherwise provided in this article. On January 1 premises
operating under a "Class B" license or permit are not required to
close. On Saturday and Sunday, no premises may remain open between
2:30 a.m. and 6:00 a.m. This subsection does not apply to a "Class
B" license issued to a winery under § 125.51(3)(am), Wis.
Stats.
D.
Between 12:00 midnight and 6:00 a.m. no person may
sell intoxicating liquor or fermented malt beverages on "Class B"
licensed premises in an original unopened package, container or bottle
or for consumption away from the premises. This subsection does not
apply to a "Class B" license issued to a winery under § 125.51(3)(am),
Wis. Stats.
E.
No premises for which a "Class B" license has been
issued under § 125.51(3)(am), Wis. Stats., may remain open
for the sale of intoxicating liquor or fermented malt beverages between
the hours of 9:00 p.m. and 8:00 a.m.
F.
Exceptions. Food stores, hotels, restaurants, and
other commercial establishments whose principal business is the sale
or furnishing of food or lodging, and bowling alleys and golf courses,
may remain open for the conduct of their regular business, but no
intoxicating liquors or fermented malt beverages shall be sold during
the applicable above-stated hours.
Any person who shall violate any provision of
this article shall, upon conviction thereof, forfeit not less than
$25 nor more than $500 together with all court costs.
