No person, firm or corporation shall build any outdoor fire within the corporate limits of the Village of New Glarus, excepting as set forth in § 122-2 of this chapter. This prohibition on burning includes burning of construction waste and debris at construction sites.

A. 
No permit needed. No permit is needed for the following types of burning as long as all other applicable ordinances are followed:
(1) 
Outdoor cooking over a fire contained in a device or structure designed for such use is permissible.
(2) 
Ceremonial campfires or bonfires are permitted as follows:
(a) 
Fire must be contained by noncombustible barrier.
(b) 
Fire must be attended at all times by at least one responsible person of 18 years of age or older.
(c) 
Fire must be a minimum of 15 feet from any structure (house, garage, accessory structure) and any lot line.
(d) 
Burning only allowed between the hours of 8:00 a.m. to 1:00 a.m.
(e) 
Fuel for ceremonial campfires or bonfires shall consist of natural wood or manufactured fire log material only and may not include leaves, rubbish, garbage, trash, construction materials, recyclable items, any material made of or coated with rubber, plastic, leather, or petroleum-based materials, and shall not contain any flammable or combustible liquids.
B. 
Permit required. The following burning activities require an approved permit from the Village or Fire Department:
(1) 
Controlled burning of grass or similar vegetation for environmental management purposes, with the prior written approval of the Fire Chief, may be permitted.
(2) 
Other occasions of desirable outdoor burning not specified by this section, but not as an alternative to refuse removal or disposal for which other methods are available, may be granted single-occasion approval by the Fire Chief.
(3) 
Any person or persons desiring to burn wood, grass, or other combustible material will apply to the Fire Chief of the Village of New Glarus Fire Department for a permit for such burning. The Chief, in his discretion, may grant such a permit without charge conditioned upon the supervision of such burning by said Fire Chief or his appointee. Any person obtaining a permit to burn shall follow the instructions and directions prescribed by said Fire Chief and shall permit said Fire Chief or his appointee to come upon the property in order to exercise the supervisory function. Whenever approval and special permit are granted by the Fire Chief under this section, the permit may specify and be conditioned on observance of safety restrictions and insurance requirements set forth therein. The Fire Chief shall notify the Police and Public Works Departments of all burning permits issued.
The Fire Chief is permitted to prohibit any or all bonfires and outdoor fires when atmospheric conditions or local circumstances make such fires hazardous.
Any person utilizing and maintaining an outdoor fire shall be responsible for any liability resulting from damage caused by that fire.
