Elected officials shall consist of the Village President, who shall be elected in off-numbered years for a term of two years, and six Trustees, three of whom shall be elected each year at the annual spring election for terms of two years.
A. 
Village Board. The following officials shall be appointed by the Village Board for indefinite terms:
(1) 
Health Officer.
(2) 
Police Chief.
(3) 
Fire Chief.
(4) 
Civil Defense Director.
(5) 
Building Inspector.

B. 
Village President.

(1) 
If appointed, the Village Clerk-Treasurer shall be appointed by the Village President with the approval of the majority of the Village Board. The Village Clerk-Treasurer shall have such powers and perform such duties as prescribed by state law and directed by the Village Board. See § 61.25, Wis. Stats., and § 61.26, Wis. Stats.
(2) 
If appointed, the Village Clerk shall have such powers and perform such duties as prescribed by state law and directed by the Village Board. See § 61.25, Wis. Stats.
(3) 
If appointed, the Village Treasurer shall have such powers and perform such duties as prescribed by state law and directed by the Village Board. See § 61.26, Wis. Stats.
A. 
Bond eliminated. The village elects not to give the bond on the Treasurer provided for by § 70.67(1), Wis. Stats.
B. 
Village liable for default of Treasurer. Pursuant to § 70.67(2) Wis Stats., the Village shall be obligated to pay, in case the Treasurer shall fail to do so, all state and county taxes required by law to be paid by such Treasurer to the County Treasurer.
A. 
General duties. The Health Officer shall:

(1) 
Maintain continuous sanitary supervision over his or her territory.
(2) 
Promote the spread of information as to the causes, nature and prevention of prevalent diseases and the preservation and improvement of health.
(3) 
Enforce the health laws, rules and regulations of the State Board of Health, the state and the Village, including the laws relating to contagious diseases contained in Ch. 252, Wis. Stats.
(4) 
Take steps necessary to secure prompt and full reports by physicians of communicable diseases and prompt and full registration of births and deaths.
(5) 
Keep and deliver to his or her successor a record of all his or her official acts.
(6) 
Make an annual report to the State Board of Health and to the Village Board and such other reports as they may request.
B. 
Materials and supplies. The Health Officer shall have authority to procure, at the expense of the village, all record books, quarantine cards and other materials needed by the Board of Health, except such as are furnished by the State Board of Health.
C. 
Rules and regulations. The Health Officer may make reasonable and general rules for the enforcement of the provisions of Chapter 161, Nuisances, and Chapter 180, Solid Waste, and for the prevention of the creation of health nuisances and the protection of the public health and welfare and may, where appropriate, require the issuance of licenses and permits. All such regulations, when approved by the Village Board, shall have the same effect as ordinances, and any person violating any of such regulations and any lawful order of the Board shall be subject to a penalty as provided in § 1-19 of this Code.

A. 
Office of the Village Administrator. In order to provide the Village of Osceola with a more efficient, effective and responsible government under a system of a part-time Village President and part-time Village Board (hereinafter referred to as "Board") at a time when Village government is becoming increasingly complex, there is hereby created the Office of Village Administrator for the Village of Osceola (hereinafter referred to as "Administrator").
B. 
Appointment, term of office and removal. The Administrator shall be appointed on the basis of merit, with due regard to training, experience, administrative ability and general fitness for the office, by a majority vote of the Board. For the purposes of appointing or terminating the Administrator, the Village President and each Board Member shall cast one vote. The Administrator shall hold office for an indefinite term subject to removal at any time by a two-thirds vote of the Board. The appointment may be terminated by the Administrator upon 60 days' written notice to the Village President and the Village Board prior to such termination. This section, however, shall not preclude the Board from establishing other employment terms and conditions not inconsistent with the provisions of this section or the Municipal Code of the Village of Osceola.
C. 
Residency. The Administrator shall become a resident of the Village of Osceola within six months following the date of appointment, unless this requirement is specifically waived or varied by Board ordinance or by contract authorized by the Board, and entered into with the Administrator, covering the terms and conditions of residency.
D. 
Functions and duties of the Administrator. The Administrator, subject to the limitations defined in resolutions and ordinances of the Village of Osceola and Wisconsin State Statutes, shall be the chief administrative officer of the Village, responsible only to the Village President and the Board for the proper administration of the business affairs of the Village, pursuant to the statutes of the State of Wisconsin, the ordinances of the Village of Osceola, and the resolutions and directives of the Board, with power and duties as follows:
(1) 
General duties:
(a) 
Carry out directives of the Village President and Board which require administrative implementation, reporting promptly to the Village President and Board any difficulties encountered herein;
(b) 
Be responsible for the administration of all day-to-day operations of the Village government, including the monitoring of all Village ordinances, resolutions, Board meeting minutes and state statutes;
(c) 
Prepare a plan of administration, including an organization chart, which defines authority and responsibility for all nonstatutory positions of the Village, and submit it to the Village Board for adoption as the official organization and administrative procedure plan for the Village;
(d) 
Establish when necessary administrative procedures to increase the effectiveness and efficiency of Village government according to current practices in local government, not inconsistent with Subsection D(1)(c) above or directives of the Village President and Board;
(e) 
Serve as ex officio nonvoting member of all Boards, commissions and committees of the Village, except as specified by the Board or Wisconsin State Statutes;
(f) 
Keep informed concerning current federal, state, and county legislation and administrative rules affecting the Village and submit appropriate reports and recommendations thereon to the Board;
(g) 
Keep informed concerning current developments in the field of municipal administration, and from time to time, submit recommendations or suggestions to improve the municipal government;
(h) 
Keep informed concerning the availability of federal, state and county funds for local programs. Assist department heads and the Board in obtaining these funds under the direction of the Village President and the Board;
(i) 
Represent the Village in matters involving legislative and intergovernmental affairs as authorized and directed as to that representation by the Village President and Board;
(j) 
Act as Public Information Officer for the Village with the responsibility of assuring that the news media are kept informed about the operations of the Village and that the public is informed of new information and developments through the oversight of a newsletter, website, and social media;
(k) 
Establish and maintain procedures to facilitate communications between citizens and Village government to assure that complaints, grievances, recommendations and other matters receive prompt attention by the responsible official and to assure that all such matters are expeditiously resolved;
(l) 
Promote, in conjunction with the Osceola Industrial Development Corporation, the Osceola Redevelopment Authority, the Osceola Main Street/Chamber, and the Polk County Economic Development Corporation, the economic and business development of the Village through the use of outreach and negotiation, marketing and promotion of development within the Village and other means to produce an expanded property tax base;
(m) 
Perform the duties of the Clerk-Treasurer in coordination with the Deputy Clerk-Treasurer in case of absence or incapacity.
(2) 
Responsibilities to the Village Board:
(a) 
Attend all meetings of the Village Board, assisting the Village President and the Board as required in the performance of their duties;
(b) 
In coordination with the Village President, the Board, and the Clerk, ensure that appropriate agendas are prepared to all meetings of the Board, all Board committees, and all other appropriate committees and commissions of the Village, together with such supporting material as may be required, with nothing herein being construed as to give the Administrator authority to limit or in any way prevent matters from being considered by the Board or any of its committees and commissions;
(c) 
Assist in the preparation of ordinances and resolutions as requested by the Village President or the Board, or as needed;
(d) 
Meet regularly with the President to keep him currently informed about the activities of the Administrator's office;
(e) 
Keep the Board currently informed about the activities of the Administrator's office, either by written report or oral briefings at regular meetings of the Board;
(f) 
Provide staff support to the Board, Administration and Finance Committee, Plan Commission, and other committees as designated by the Board.
(3) 
Personnel.
(a) 
Be responsible for providing administrative direction and coordination of all department heads of the Village according to the established organization procedures;
(b) 
Recommend to the Board the appointment, promotion and, when necessary for the good of the Village, the suspension or termination of department heads and, with department head support, all other employees below the department head level;
(c) 
Serve as Personnel Officer for the Village with responsibilities to see that complete and current personnel records, including specific job descriptions, for all Village employees are kept; evaluate in conjunction with department heads the performance of all employees on a regular basis; recommend salary and wage scales for Village employees not covered by collective bargaining agreements; develop and enforce high standards of performance by Village employees; assure that Village employees have proper working conditions; work closely with department heads to promptly resolve personnel problems or grievances;
(d) 
Assist in labor contract negotiations and collective bargaining issues;
(e) 
Work closely with department heads to assure that employees receive adequate opportunities for training to maintain and improve their job-related knowledge and skills and act as the approving authority for requests by employees to attend conferences, meetings, training schools, etc., provided that funds have been budgeted for these activities.
(4) 
Budgeting and purchasing:
(a) 
Support the Administration and Finance Committee in the preparation of the annual Village budget in accordance with Village Code;
(b) 
Administer the budget as adopted by the Board;
(c) 
Report regularly to the Board on the current fiscal position of the Village and the current status of expenditures relative to the Village budget;
(d) 
Supervise the accounting system of the Village and insure that the system employs methods in accordance with current professional accounting practices;
(e) 
Serve as the Purchasing Agent for the Village, supervising all purchasing and contracting for supplies and services, subject to the purchasing procedures established by the Board and any limitation contained in the Wisconsin State Statutes.
E. 
Cooperation. All officials and employees of the Village shall cooperate with the Administrator so that the Village government shall function effectively and efficiently.
F. 
Severability. The provisions of this section shall be deemed severable, and it is expressly declared that the Board of the Village of Osceola would have passed the other provisions of this section irrespective of whether or not one or more provisions may be declared invalid, and if any provisions of this section or the application thereof to any person or circumstances is held invalid, the remainder of the section and the application of such provision to other persons or circumstances shall not be affected thereby.
