A.
State statutes. Except as otherwise specifically provided
in this chapter, the statutory provisions in W.S.A. chs. 340 to 348,
describing and defining regulations with respect to vehicles and traffic,
exclusive of any provisions therein relating to penalties to be imposed
and exclusive of any regulations for which the statutory penalty is
a fine or term of imprisonment, are adopted and by reference made
a part of this chapter as if fully set forth herein. Any act required
to be performed or prohibited by any statute incorporated herein by
reference is required or prohibited by this chapter. Any future amendments,
revisions or modifications of the statutes incorporated herein are
intended to be made part of this chapter in order to secure uniform
statewide regulation of traffic on the highways, streets and alleys
of the state.

B.
Wisconsin Administrative Code. The provisions of Chapter
Trans 305, Wisconsin Administrative Code, as amended from time to
time, are hereby incorporated by reference as set forth in full herein,
exclusive of any provisions therein relating to penalties. Any act
as required to be preformed or prohibited by such chapter is required
or prohibited by this chapter.

C.
When written as an ordinance violation, the code cited
shall be the appropriate state statute number preceded by "5-." [Example:
State statute s. 346.63(1)(a) would be 5-346.63(1)(a) for a code violation.]

A.
State speed limits adopted. The provisions of W.S.A. ss. 346.57, 346.58 and 346.59, relating to the maximum and minimum speed of vehicles, are hereby adopted as part of this section as if fully set forth herein, except as specified by Subsection B pursuant to W.S.A. s. 349.11(3)(c).
B.
Speed limits increased. The speed limits are increased
as hereinafter set forth upon the following streets between the points
designated:

STH 35: within the Village limits, 25 miles per hour,
except where otherwise posted.

C.
Speed limits on streets in and adjacent to public
parks. The speed limit on any Village street within, contiguous to
or adjacent to a public park or recreation area is reduced to 15 miles
per hour when children are going to or from or are playing within
such area.
No person shall operate any truck having a gross
weight exceeding 12,000 pounds on the bridge over Osceola Creek located
on Third Avenue East.

M.
No person owning or having control of any truck, trailer,
truck power unit, tractor, bus, or recreational vehicle in excess
of 10,000 pounds' gross vehicle weight or over 16 feet in length or
having an enclosed area of a height more than eight feet from the
roadway shall park the same upon any street, avenue or public way
in the Village between the hours of 6:00 p.m. and 7:00 a.m. One-hour
parking will be allowed between 7:00 a.m. and 6:00 p.m. The provisions
of this subsection shall not be deemed to prohibit the lawful parking
of such equipment upon any street, avenue or public way in the Village
for the actual loading or unloading of goods, wares, or merchandise;
provided, however, that “loading” and “unloading,”
as used in this subsection, shall be limited to the actual time consumed
in such operation. The Village Board may, however, designate specific
truck parking zones.

N.
There shall
be no parking on the north side of Saratoga Avenue.

A.
When signs are erected in any block giving notice
thereof, no person shall park any vehicle for longer than 30 minutes
between 2:00 a.m. and 6:00 a.m. of any day.
B.
No person shall park any unoccupied vehicle on any
street in the Village between the hours of 2:00 a.m. and 6:00 a.m.
between November 15 and April 15, except with prior police approval.
C.
Any vehicle in violation of this section shall be
subject to being towed away by agents of the Village. Owners of vehicles
towed shall be assessed a towing charge, together with a parking ticket
and a storage charge, as set by resolution of the Village Board from
time to time,[1] for each twenty-four-hour period after the first 24 hours, or may be subject to a forfeiture as set forth in § 1-19 of this Code. All such charges shall be payable before any such vehicle is released from impoundment.

D.
Abandoned vehicles shall be towed at the direction of a police officer in the manner prescribed in Subsection C above. Persons in violation of this section shall be subject to the forfeiture, towing and storage fee as stated in Subsection C above. Abandoned vehicles are defined as those parked on a public street or public parking lot and which do not appear to have been moved for a period of 48 hours, except those vehicles in the Village parking lot on Fourth Avenue, west of Cascade Street, having and displaying a valid parking permit issued by the Village of Osceola, or do not display a current registration plate.

A loading zone not exceeding 50 feet in length
is established on the east side of Cascade Street between official
signs erected by the Village. No person shall park any vehicle other
than a delivery truck in such loading zone between the hours of 8:30
a.m. and 3:30 p.m. on Monday through Friday, inclusive.

Except as provided in § 346.50(3), Wis.
Stats., no person may park, stop or leave standing any vehicle, whether
attended or unattended and whether temporarily or otherwise, upon
any portion of a Village street or highway or parking facility held
open for public use reserved by official traffic signs or distinct
markers indicating the restriction for vehicles displaying special
registration plates issued under § 341.14(1), (1a), (1m)
or (1q), Wis. Stats., or a special identification card issued by the
Department of Motor Vehicles or the Village Police Department.
B.
The most easterly parking spot on Third Avenue west
of Cascade Street on the south side of the street is hereby designated
as handicapped only parking.

A.
Second Avenue from the Hill Street intersection in
a generally westerly direction to its intersection of the railroad
tracks and the southeasterly corner of Outlot 104 and the southwesterly
corner of Outlot 103 of the outlot plat of the Village shall be one-way
heading in a generally westerly direction.
(1)
The one-way portion of Second Avenue shall have all
truck traffic prohibited with the exception of service vehicles.
(2)
Service vehicles, for purposes of this Subsection A, shall be defined as any vehicle used for the pickup or delivery of commodities or products to the residences which access the one-way portion of Second Avenue.[1]

A.
Definition. A snow removal emergency is a condition
of streets or other public highways where the snowfall has accumulated
or has fallen in such manner as to produce a congestion of traffic.
Any snowfall of four inches or more shall constitute a snow removal
emergency.
B.
Notice. The Village Clerk shall give to the news media
an informal notice, as quickly as possible, of the existence of a
snow removal emergency, but the failure to receive such notice shall
not excuse any person from obeying this section. Owners of vehicles
may also be notified by placement of notices on windshields of their
vehicles.
C.
Parking prohibited. As long as a snow removal emergency
exists in any street, no vehicle shall park thereon or on any arterial
street until the street is fully plowed. Any person violating this
section may be given a parking ticket as set by resolution of the
Village Board from time to time[1] or may be subject to a forfeiture as set forth in § 1-19 of this Code.

D.
Removal of vehicles. Any vehicle parked contrary to
this section may be towed away and the cost thereof assessed to the
owner of such vehicle.
A.
This section shall apply to all premises held out
to the public for use of their motor vehicles, whether such premises
are publicly or privately owned and whether or not a fee is charged
for the use thereof.
B.
No person shall operate a motor vehicle on such premises:
(1)
At a speed in excess of 20 miles per hour.
(2)
Outside of driving lanes indicated by painted lines.
(3)
Across parking stalls indicated by painted lines,
provided that this subsection shall not apply to entering and occupying
a parking stall.
(4)
In a manner known as "spinning doughnuts," wherein
the vehicle is driven rapidly in a tight radius.
(5)
At a rapid or sudden acceleration that results in
the squealing of tires or the leaving of tire marks.
Pursuant to the authority granted by W.S.A.
s. 349.21, it is required that school bus operators operating in a
residence or business district, when pupils or other authorized passengers
are to be loaded or unloaded at a location at which there are no crosswalks
or traffic signals and such persons must cross the street or highway
before being loaded or after being unloaded, shall actuate red flashing
warning lights before stopping to load or unload pupils or other authorized
passengers, and such lights shall not be extinguished until loading
or unloading is completed and persons who must cross the highway are
safely across.
A.
Restrictions.
(1)
No person shall operate or ride a skateboard, roller
skates, roller skis or play vehicles as defined in W.S.A. s. 340.01
in any of the following places:
(a)
On any sidewalk or street in any commercial
district, that being Cascade Street between Fifth Avenue and CTH "M"
and intersection streets there between for a distance of one block
east and one block west thereof, or state or county trunk highways.
(b)
In any public parking ramp or parking lot.
(c)
On any public property where signs prohibit
it.
(d)
On private property, unless permission has been
received from the owner, lessee or person in charge of that property.
(2)
No person shall operate or ride a bicycle on a sidewalk
adjacent to Cascade Street between Fifth Avenue and CTH "M" and upon
sidewalks adjacent to all intersection streets there between for a
distance of one block east and one block west thereof.
(3)
Bicyclists and operators or riders of skateboards,
roller skates, roller skis or play vehicles shall yield the right-of-way
to other pedestrians using other Village sidewalks and shall not otherwise
endanger or interfere with pedestrian traffic on those sidewalks.
B.
Penalty.
(1)
First offense. The item shall be confiscated by the
police and returned only after a conference between the Police Department,
the child and the child's parents if a juvenile. If an adult, the
penalty shall be the same as for a second offense.
(2)
Second offense. The item shall be confiscated by the
police and returned only after a conference between the Police Department,
the child and the child's parents, plus a penalty of $25 and court
costs.
(3)
Third offense. The item shall be confiscated by the
police and returned only after a conference between the Police Department,
the child and the child's parents, plus a penalty of $50 and court
costs.

A.
Compression braking prohibited. No person shall, in
the operation of any motor vehicle within the corporate limits of
the Village, use brakes on that motor vehicle which are in any way
activated by or operated by the compression of the engine of the motor
vehicle or of any unit or part thereof. For the purposes of this section,
the term "engine brake" or "engine braking" may be used interchangeably
with that of compression braking and shall refer to the same practice
of braking a motor vehicle through nonmagnetic or hydraulic methods.

B.
Emergency vehicles exempt from ordinance application.
This section shall not be applied to or against the use of compression
braking on official municipal motor vehicles used in association with
emergency responses.

The penalty for violation of any provision of
this chapter shall be a forfeiture and penalty assessment if required
by W.S.A. s. 165.87 and a jail assessment if required by W.S.A. s.
302.46(1), plus any applicable fees prescribed in W.S.A. ch. 814.
A.
State statutes. Any forfeiture for violation of the
state statutes adopted by reference herein shall conform to the forfeiture
permitted to be imposed for violation of such statutes as set forth
in the Uniform Deposit and Misdemeanor Bail Schedule of the Wisconsin
Judicial Conference, including any variations or increases for subsequent
offenses, which schedule is adopted by reference.
A.
Procedure. This chapter shall be enforced according
to W.S.A. ss. 66.12 and 345.11 to 345.61 and ch. 799, including W.S.A.
s. 345.28, relating to the issuance of summonses for nonmoving traffic
violations, and all enforcement procedures set forth in said section
are hereby incorporated by reference. The "local authority" referred
to in this statute is hereby designated to be the Osceola Police Department.

B.
Unpaid judgment. The provisions of W.S.A. s. 345.47(1)(d)
relating to unpaid court judgments for traffic offenses and the enforcement
procedures set forth in said section are hereby incorporated by reference.
C.
Deposit.
(1)
Any person arrested for a violation of this chapter
may make a deposit of money as directed by the arresting officer at
the police station or at the office of the Clerk of Court or by mailing
the deposit to such places. The arresting officer or the person receiving
the deposit shall notify the arrested person, orally or in writing,
that:
(a)
If the person makes a deposit for a violation
of a traffic regulation, the person need not appear in court at the
time fixed in the citation and the person will be deemed to have tendered
a plea of no contest and submitted to a forfeiture and penalty assessment
if required by W.S.A. s. 165.87 and a jail assessment if required
by W.S.A. s. 302.46(1), plus any applicable fees prescribed in W.S.A.
ch. 814, not to exceed the amount of the deposit that the court may
accept as provided in W.S.A. s. 345.37.

(b)
If the person fails to make a deposit for a
violation of a traffic regulation or appear in court at the time fixed
in the citation, the court may enter a default judgment finding the
person guilty of the offense or issue a warrant for his or her arrest.
(2)
The amount of the deposit shall be determined in accordance
with the State of Wisconsin Revised Uniform State Traffic Deposit
Schedule established by the Wisconsin Judicial Conference and shall
include the penalty assessment established under W.S.A. s. 165.87,
court costs and jail assessment. If a deposit schedule has not been
established, the arresting officer shall require the alleged offender
to deposit not less than the maximum forfeiture permitted under this
chapter, which shall include the penalty assessment established under
W.S.A. s. 165.87. Deposits for nonmoving violations shall not include
the penalty assessment.
(3)
The arresting officer or the person receiving the
deposit shall issue the arrested person a receipt therefor as required
by W.S.A. s. 345.26(3)(b).
D.
Petition to reopen judgment. Whenever a person has
been convicted in this state on the basis of a forfeiture of deposit
or a plea of guilty or no contest and the person was not informed
as required under W.S.A. s. 345.27(1) and (2), the person may, within
60 days after being notified of the revocation or suspension of the
operating privilege, petition the court to reopen the judgment and
grant him or her an opportunity to defend on merits. If the court
finds that the petitioner was not informed as required under W.S.A.
s. 345.27(1) and (2), the court shall order the judgment reopened.
The court order reopening the judgment automatically reinstates the
revoked or suspended operating privilege.
