Pursuant to § 32.08, Wis. Stats., a Condemnation Commission is created.
The Condemnation Commission shall consist of six Commissioners. The Pierce County Circuit Court Judge shall appoint the Commissioners for three-year terms. However, the first appointments shall be made for staggered terms of 1, 2, and 3 years as determined by the Judge. Not more than one-third of the commission shall be attorneys at law, licensed for active practice in this state. Commissioners may be removed at the Judge's pleasure. All appointments and removals shall be filed with the Pierce County Clerk of Court.
Each Commissioner shall be a resident of Pierce County or a resident of an adjoining County in the same judicial circuit.
The Commissioners shall annually elect one of their members as Chairperson. The Chairperson shall select and notify the commissioners that are to preside at condemnation hearings. Three Commissioners shall preside at each hearing.
The Commissioners shall be compensated for actual service performed at an hourly rate as established by resolution of the Pierce County Board of Supervisors. The Chairperson shall also be compensated at the hourly rate for selecting and notifying the Commissioners that are to preside at a hearing in addition to any necessary out-of-pocket expenses in connection with the hearing. All Commissioners are entitled to receive mileage reimbursement pursuant to the County travel policy. Such compensation and expenses shall be paid by the condemnor on order approved by the Circuit Court Judge.
