Trees standing in and upon any public street
or place, or upon any lot or land adjacent thereto shall be pruned
and trimmed by the Village so that the lowest branches projecting
over the public street or alley will provide a clearance of not less
than 14 feet and a clearance of not less than 10 feet over any other
public place, so that no dead, broken or otherwise hazardous branches
shall be likely to fall and do injury to the public. Any tree not
trimmed as herein provided shall be deemed hazardous.

No person shall plant, cut, prune or remove
any tree or shrub in a public street in the Village, or cut, disturb
or interfere in any way with the roots of any tree in such public
street, or spray any such trees or shrubs with chemicals or insecticides
without written permission of the Public Works Superintendent.

No shade or ornamental tree or shrub shall be
planted in any of the public streets of the Village until such tree
or shrub and the place where it is to be planted shall have first
been approved by the Public Works Superintendent.
No person shall break or injure any tree or
shrub planted in any highway of the Village, nor pour salt water upon
any such public highway in such place as to injure any tree or shrub
planted or growing therein.
No person shall prevent, delay or interfere
with the Village Board or its employees in the planting, pruning,
spraying or removing of trees or shrubs, living or dead, in that part
of any street lying between the lot line and the curb or in the center
of side plots of boulevards in the Village, or from removing stone,
cement, lumber or other substance placed about a tree or shrub in
a public street in the Village.

As used in this chapter, the following terms
shall have the meanings indicated:
Trees, shrubs, bushes and all other woody vegetation in public
parks having individual names and all areas owned by the Village or
to which the public has free access as a park.
Trees, shrubs, bushes and all other woody vegetation on land
lying between property lines on either side of all streets, avenues
or ways within the Village.
A.
There is hereby created and established a Village
Tree Board for the Village which shall consist of five members, citizens
and residents of the Village who shall be appointed by the Village
President with the approval of the Village Board.
B.
Term of office. The term of the five persons to be
appointed by the President shall be three years, except that the term
of two of the members appointed to the first Board shall be for only
one year, and the term of two members of the first Board shall be
for two years. In the event that a vacancy shall occur during the
term of any member, his successor shall be appointed for the unexpired
portion of the term.
C.
Compensation. Members of the Board shall serve without
compensation.
D.
Duties and responsibilities. The Board shall study,
investigate, counsel and develop and/or update annually and administer
a written plan for the care, preservation, pruning, planting, replanting,
removal or disposition of trees and shrubs in parks, along streets
and in other public areas. Such plan will be presented annually to
the Village Board and, upon their acceptance and approval, shall constitute
the official comprehensive Village tree plan for the Village. The
Board, when requested by the Village Board, shall consider, investigate,
make findings, report and recommend upon any special matter of question
coming within the scope of its work.
E.
Operation. The Tree Board shall choose its own officers,
make its own rules and regulations and keep a journal of its proceedings.
A majority of the members shall be a quorum for the transaction of
business.

All street
trees to be planted shall be a minimum two-inch caliber and balled
and burlap.
The spacing of street trees will be in accordance with the three species size classes listed in § 187-8, and no trees may be planted closer together than the following: small trees, 30 feet; medium trees, 40 feet; large trees, 50 feet; except in special plantings designed or approved by a landscape architect.
The distance trees may be planted from curbs or curb lines and sidewalks will be in accordance with the three species size classes listed in § 187-8, and no trees may be planted closer to any curb or sidewalk than the following: small trees, two feet; medium trees, three feet; large trees, four feet. If the parkway is less than five feet wide, no trees will be planted.
No street tree shall be planted closer than
35 feet of any street corner, measured from the point of nearest intersecting
curbs or curb lines. No street trees shall be planted closer than
10 feet to any fireplug.
No street trees other than those species listed in small trees in § 187-8 may be planted under or within 10 lateral feet of any overhead utility wire or over or within 20 lateral feet of any underground waterline, sewer line, transmission line or other utility.
A.
The Village shall have the right to plant, prune,
maintain and remove trees, plants and shrubs within the lines of all
streets, alleys, avenues, lanes, squares and public grounds as may
be necessary to ensure public safety or to preserve or enhance the
symmetry and beauty of such public grounds.
B.
The Village Tree Board may remove or cause or order to be removed any tree or part thereof which is in an unsafe condition or which by reason of its nature is injurious to sewers, electric power lines, gas lines, waterlines or other public improvements or is affected with any injurious fungus, insect or other pest. This subsection does not prohibit the planting of street trees by adjacent property owners, provided that the selection and location of such trees is in accordance with §§ 187-8 through 187-12 of this chapter.
No person, firm or Village department shall,
as a normal practice, top any street tree, park tree or other tree
on public property. Topping is defined as the severe cutting back
of limbs to stubs larger than three inches in diameter within the
tree's crown to such a degree so as to remove the normal canopy and
disfigure the tree. Trees severely damaged by storms or other causes
or certain trees under utility wires or other obstructions, where
other pruning practices are impractical, may be exempted from this
section at the determination of the Village Tree Board.
Every owner of any tree overhanging any street
or right-of-way within the Village shall prune the branches so that
such branches shall not obstruct the light from any streetlamp or
obstruct the view of any street intersection and so that there shall
be a clear space of eight feet above the surface of the street or
sidewalk. Such owners shall remove all dead, diseased or dangerous
trees or broken or decayed limbs which constitute a menace to the
safety of the public. The Village shall have the right to prune any
tree or shrub on private property when it interferes with the proper
spread of light along the street from a streetlight or interferes
with visibility of any traffic control device or sign.
The Village shall have the right to cause the
removal of any dead or diseased trees on private property within the
Village, when such trees constitute a hazard to life and property
or harbor insects or disease which constitute a potential threat to
other trees within the Village. The Village Tree Board will notify
in writing the owners of such trees. Removal shall be done by such
owners at their own expense within 60 days after the date of service
of notice. In the event of failure of owners to comply with such provisions,
the Village shall have the authority to remove such trees and charge
the cost of removal on the owner's property tax notice.
All stumps of street and park trees shall be
removed below the surface of the ground so that the top of the stump
shall not project above the surface of the ground.
No person shall prevent, delay or interfere
with the Village Tree Board or any of its agents while engaging in
and about the planting, cultivating, mulching, pruning, spraying or
removing of any street trees, park trees or trees on private grounds
as authorized in this chapter.

The Village Board shall have the right to review
the conduct, acts and decisions of the Village Tree Board. Any person
may appeal from any ruling or order of the Village Tree Board to the
Village Board who may hear the matter and make a final decision.

A.
General.
The Village shall provide branch and brush chipping to owners and
occupants of single-family and two-family residences within the Village
every Monday of each month from April through October of each year,
provided that the owner or occupant complies with the terms and conditions
set forth herein. There will be no curbside chipping any week in which
a holiday occurs. The Village will provide branch chipping only for
branches resulting from tree trimming or tree maintenance. The Village
will not accept or chip any branches resulting from tree removal or
branches greater than three inches in diameter. The property owner
or occupant is responsible for disposal of branches resulting from
tree removal or branches greater than three inches in diameter.

B.
Preparation.
(1)
Branches.
Branches shall be kept in as neat a pile as possible, with the cut
ends toward the road. Branches shall be placed at the curb on the
parkway and may not extend on to the street or sidewalk. Branches
may not be larger than three inches in diameter.

(2)
Brush.
Chippable brush shall be kept in a separate pile from branches. Brush
shall be placed at the curb in the same manner as branches. No compost,
leaves, grass or stumps are to be placed in the brush pile.
C.
Schedule. A property owner or occupant may not place branches or brush on the parkway prior to the weekend before the chipping day established in Subsection A. All branches and/or brush piles must be able to be chipped in 20 minutes. Any branches or brush remaining after 20 minutes of chipping will be left and must be removed from the parkway by the owner or occupant within 24 hours. At the owner's or occupant’s option, additional twenty-minute chipping intervals beyond the base twenty-minute interval may be contracted for with the Village for a fee as established by resolution of the Village Board to reasonably compensate for labor, equipment and administrative costs.
D.
Compost
site. No branches or brush will be accepted at the Public Works compost
dropoff site.
Except as otherwise provided in this chapter, any person who violates any provision of this chapter shall be subject to a penalty as provided in § 1-19 of this Code.
