A.
No person shall conduct a rummage or garage sale within the City without having obtained a license from the Clerk-Treasurer, except as provided in § 300-2 below. Before issuing the license, the Clerk-Treasurer shall refer the application to the Building Inspector for verification as to whether or not such sale at the proposed location is compatible with Chapter 385, Zoning, of this Code.
B.
Definition:
the selling or offering for sale of used or secondhand personal property
to the general public on a temporary basis. This includes all sales
entitled "garage sale," "lawn sale," "attic sale," "rummage sale,"
"tag sale," "flea market sale," or any similar casual sale of tangible
personal property, which sale is advertised by any means whereby the
public at large is or can be made aware of said sale.

No person shall be required to obtain a license
if:
A.
The sale is conducted in a business district and is
a permitted use in such district.
B.
The person conducts, on his own residential premises,
no more than three sales in any one year. Each sale may be held for
no more than three consecutive days and shall not be conducted between
the hours of 8:00 p.m. and 8:00 a.m.
C.
The sale is conducted by religious, educational, charitable
or civic organizations on premises located in a residential district
no more than three times in any one year. Each such sale may be held
for no more than three consecutive days and shall not be conducted
between the hours of 8:00 p.m. and 8:00 a.m.

The license fee shall be as stated in the City
of Waterloo Fee Schedule[1] for such sale not to exceed three days.

Signs may not be posted on traffic information or regulatory
sign posts. All signs must be removed within 48 hours of the completion
of the sale.
