GENERAL REFERENCES

The provisions of § 66.0435, Wis. Stats., and the definitions therein are hereby adopted by reference.
There is hereby imposed on each occupied or unoccupied nonexempt mobile home located in the Village of Westfield a monthly parking fee as determined in accordance with § 66.0435, Wis. Stats. Said fee shall be paid to the Village Clerk-Treasurer on or before the 10th day of the month following the month for which such fees are due.

It shall be unlawful for any person to establish or operate upon property owned or controlled by him within the Village of Westfield a mobile home park without having first secured a license therefor from the Village Clerk-Treasurer. The application for such license shall be accompanied by a fee as set by the Village Board for each space in the existing or proposed park. The license shall expire one year from the date of issuance. Such parks shall comply with Ch. Comm 95, Wis. Adm. Code, which is hereby adopted by reference.
This chapter specifically excludes small recreational mobile homes and camping trailers which are not subject to parking fees. A small recreational mobile home is a home that is designed to be transported from place to place by a motor vehicle in the regular course of recreational activities, also known as "RV's," to be used in the same manner as a camping trailer.
A. 
Licensees of mobile home parks and owners of land on which are parked any occupied nonexempt mobile homes shall furnish information to the Village Clerk-Treasurer and the Village Assessor on such homes added to their park or land within five days after arrival of such home on forms furnished by the Village Clerk-Treasurer in accordance with § 66.0435(3)(c), Wis. Stats.
B. 
Occupants or owners of nonexempt mobile homes parked outside of a mobile home park shall remit such fees directly to the Village Treasurer-Clerk as provided in § 345-2 herein. It shall be the full and complete responsibility of the licensee of a mobile home park to collect such fees from each occupied nonexempt mobile home therein and to remit such fees to the Village Clerk-Treasurer as provided in § 345-2.
C. 
Owners of nonexempt occupied mobile homes, upon receipt of notice from the Village Clerk-Treasurer of the liability for the monthly parking permit fee, shall remit to the Village Clerk-Treasurer a cash deposit of $25 to guarantee payment of such fees when due to the Village Clerk-Treasurer. It shall be the full and complete responsibility of the licensee of a mobile home park to collect such cash deposits from each occupied nonexempt mobile home therein and remit such deposits to the Village Clerk-Treasurer. Upon receipt of a notice from the owner or licensee that the nonexempt occupied mobile home has been or is about to be removed from the Village, the Village Clerk-Treasurer shall apply said cash deposit to reduce any monthly parking permit fees for which said owner is liable and refund the balance, if any, to said owner.
D. 
The Village Board hereby authorizes mobile home park operators who are required by municipal ordinance to collect monthly mobile home parking fees to deduct and retain 2% of the total fees collected for administrative expenses.
Any person, firm or corporation who or which fails to comply with any provisions of this chapter shall, upon conviction thereof, be subject to a penalty as provided in Chapter 1, § 1-3 of this Code.

A mobile home would be taxed as personal property if the land upon which it is located is not owned by the mobile home owner or if the mobile home is not set upon a foundation or connected to utilities.
