GENERAL REFERENCES

This chapter is enacted in accordance with 30-A M.R.S.A.
As used in this chapter, the following terms shall have the meanings indicated:
ATV
Any recreational vehicle including motorcycles, motorbikes, trail bikes, all-terrain vehicles, go-carts or any similar type of vehicle that is designed principally for use off-road. This term shall not include any vehicle that is designed or used principally for agricultural purposes.
A person may not operate an ATV upon land of another unless the person has written permission of the landowner or the landowner's agent or unless the landowner specifically permits the operation of ATVs on the land without written permission as recorded with the Madison Police Department or the landowner has designated specific ATV trails through placement of signs.
Violation of this chapter shall be a civil infraction. Penalties for a violation shall be not less than $100 and not more than $500.
If a court of competent jurisdiction shall declare any portion of this chapter invalid, such invalidity shall not affect the remaining sections or provisions of this chapter.
