As used in this article, the following words and phrases shall have the following meanings unless the context clearly indicates a different meaning:
- Kitchen refuse, all meat, vegetable and fruit refuse, small animals and dead fowl.
- Any residence, business, industry, or other place where garbage, trash, or rubbish accumulates.
- Tin cans, bottles, glass, metal scraps, and wire scraps.
- Paper, rags, old clothing, paper containers, pieces of wood, rubber or plastic, boxes, barrels or crates, feathers, weeds, grass and tree limbs or shrub limbs.
This article shall apply to all garbage, rubbish, and trash to be picked up by the Town refuse system.

Garbage collection rates shall be set at $20.50 per month for all residential customers, whether such solid waste disposal service is used or not, and whether on vacation or in the residence. Commercial customers shall be billed by and shall pay the City's solid waste franchisee directly, rather than paying the City.

A fee per cubic yard, as set forth from time to time by resolution of the Town Council, is hereby levied for the collection of leaves, grass and weed clippings which are not bundled, bagged or boxed as required for pickup by the garbage pickup service. Such fee shall be imposed in addition to the regular monthly garbage pickup fee, if any, for any resident.

All amounts due, whether from residences or places of business, shall be payable monthly at the Town Office, and failure to pay the same shall subject the owner of the residence, business, house trailer, mobile home, camper or motor home to a lien against his property for any amounts due hereunder, or the Town may elect to pursue its legal remedies and seek judgment against the delinquent person. It is further provided that said garbage collection service may be discontinued upon failure of the persons served to pay as set forth herein.
All residences and places of business shall be subject to the payment of this levy whether the services are actually used or not, net payment being required on a standby basis, and any person who allows his garbage or other refuse to accumulate and create a health or safety hazard shall be subject to the penalty provisions of § 229-10 of this article.

No garbage, rubbish, or trash shall be collected by the Town refuse system or placed outside for collection by the Town refuse system except garbage, rubbish, and trash from premises within the Town limits. No person shall move any materials from one location to another to evade the provisions of this article.
All garbage placed for collection shall be stored in a securely tied plastic bag inside a metal or plastic garbage can with a tight-fitting lid. All rubbish placed for collection must be in a securely tied plastic bag. Trash placed for collection must be in a securely tied plastic bag, provided that papers may be placed in a cardboard carton or tied in bundles weighing not more than 25 pounds, cardboard boxes are to be flattened and tied in bundles not weighing more than 25 pounds, and brush from tree limbs or bushes may be tied in bundles not more than three feet long and weighing not more than 25 pounds each. All glass with sharp corners and all sharp items shall be securely wrapped to prevent damage to the plastic sack and to prevent injury to any person collecting the plastic sacks.
All garbage cans shall be kept in a clean and sanitary condition. No garbage can shall be used unless the lid remains in a condition to provide a tight fit on the garbage can. The garbage can shall be equipped with handles so that it may be lifted and carried by one person. No such container shall have a capacity of more than 35 gallons.
No person shall tamper with any plastic bag containing any garbage, refuse, or trash. No person shall tamper with any bundle or box of material placed for collection under this article. No owner of any dog shall permit any dog to damage or open any plastic sack or garbage can or any bundle of papers or tree limbs or shrubs anywhere in the Town. It shall be the responsibility of the dog owner to control the actions of the dog and to replace all garbage, trash, or rubbish suitable for collection as provided by § 229-5.
No large dead animals shall be placed for collection under the terms of this article. No bricks, concrete, lumber, ashes, dirt, plaster, sand, gravel, or large chunks of metal, such as automobile frames, or other heavy material shall be placed for collection under the terms of this article. No animal manure, no oil waste and no dangerous substance shall be placed for collection by the Town Refuse Department or collected by the Town Refuse Department.
The Town Refuse Department shall not pick up any materials placed for collection in violation of any of the terms of this article.
Any person, firm, or corporation violating any provisions of this article shall be fined not less than $20 nor more than $500 for each offense, and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
